Amends the Long-Term Care Provider Funding Article of the Illinois Public Aid Code. Exempts long-term care providers that are organized as not-for-profit entities from the annual assessment imposed on such providers under the Article.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Section 5B-3 as follows:
|
6 | | (305 ILCS 5/5B-3) (from Ch. 23, par. 5B-3)
|
7 | | Sec. 5B-3. Exemptions. |
8 | | (a) A long-term care provider which is a
county with a |
9 | | population of more than 3 million that makes
intergovernmental |
10 | | transfer payments as provided in Section 15-3 of
this Code |
11 | | shall be exempt from the assessment imposed by Section
5B-2 |
12 | | unless the exemption is adjudged to
be unconstitutional or |
13 | | otherwise invalid, in which case the
county shall pay the |
14 | | assessment imposed by Section 5B-2 for all
assessment periods |
15 | | beginning on or after July 1, 1992,
and the assessment so paid |
16 | | shall be creditable against the
intergovernmental transfer |
17 | | payments.

18 | | (b) A long-term care provider that is organized as a |
19 | | not-for-profit entity shall be exempt from the assessment |
20 | | imposed by Section 5B-2. |
