AMENDMENT TO HOUSE BILL 4559

AMENDMENT NO. ______. Amend House Bill 4559 by replacing everything after the enacting clause with the following:

"Section 5. The University of Illinois Act is amended by adding Section 90 as follows:

(110 ILCS 305/90 new)

Sec. 90. Athletic uniform and equipment reporting requirements.

(a) In this Section:

"Articles of clothing" means items worn to cover any part of the body, including without limitation headgear, sweatbands, socks, and footwear.

"Athletes" means students of the university who participate in an interscholastic, university-sponsored, or university-supported athletic activity.

"Headgear" means a helmet, hat, or any other item worn on the head.

"Sports equipment" means any object needed to participate in an interscholastic, university-sponsored, or university-supported athletic activity, including without limitation a ball, disc, bat, stick, club, or racquet. "Sports equipment" does not include sports equipment that an athlete owns, unless the athlete is required to purchase a particular manufacturer's sports equipment.

(b) Each year, on or before October 1, the university shall report to the Board of Higher Education all of the following information:

(1) The location of final assembly of those uniform articles of clothing athletes for a particular athletic activity are required to wear, whether during practice, during competition, or at any other time.

(2) The location of final assembly of sports equipment used by athletes.

(3) Whether the university has entered into a contract to provide uniform articles of clothing or sports equipment under item (1) or (2) of this subsection (b), the parties to that contract, the duration of that contract, and the amount the university must pay under that contract.

(4) The total amount the university is paying for uniform articles of clothing or sports equipment under item (1) or (2) of this subsection (b).

(c) Each year, the Board of Higher Education shall compile the information reported under subsection (b) of this Section and post that information on its Internet website on or before December 1.

The Board of Higher Education may adopt any rules necessary to implement and administer this Section.

Section 10. The Southern Illinois University Management Act is amended by adding Section 75 as follows:

Sec. 75. Athletic uniform and equipment reporting requirements.

(a) In this Section:

"Articles of clothing" means items worn to cover any part of the body, including without limitation headgear, sweatbands, socks, and footwear.

"Athletes" means students of the university who participate in an interscholastic, university-sponsored, or university-supported athletic activity.

"Headgear" means a helmet, hat, or any other item worn on the head.

"Sports equipment" means any object needed to participate in an interscholastic, university-sponsored, or university-supported athletic activity, including without limitation a ball, disc, bat, stick, club, or racquet. "Sports equipment" does not include sports equipment that an athlete owns, unless the athlete is required to purchase a particular manufacturer's sports equipment.

(b) Each year, on or before October 1, the university shall report to the Board of Higher Education all of the following information:

(1) The location of final assembly of those uniform articles of clothing athletes for a particular athletic activity are required to wear, whether during practice, during competition, or at any other time.

(2) The location of final assembly of sports equipment used by athletes.

(3) Whether the university has entered into a contract to provide uniform articles of clothing or sports equipment under item (1) or (2) of this subsection (b), the parties to that contract, the duration of that contract, and the amount the university must pay under that contract.

(4) The total amount the university is paying for uniform articles of clothing or sports equipment under item (1) or (2) of this subsection (b).

(c) Each year, the Board of Higher Education shall compile the information reported under subsection (b) of this Section and post that information on its Internet website on or before December 1.

The Board of Higher Education may adopt any rules necessary to implement and administer this Section.

Section 15. The Chicago State University Law is amended by adding Section 5-185 as follows:

(a) In this Section:

"Articles of clothing" means items worn to cover any part of the body, including without limitation headgear, sweatbands, socks, and footwear.

"Sports equipment" means any object needed to participate in an interscholastic, university-sponsored, or university-supported athletic activity, including without limitation a ball, disc, bat, stick, club, or racquet. "Sports equipment" does not include sports equipment that an athlete owns, unless the athlete is required to purchase a particular manufacturer's sports equipment.

(b) Each year, on or before October 1, the university shall report to the Board of Higher Education all of the following information:

Section 20. The Eastern Illinois University Law is amended by adding Section 10-185 as follows:

Section 30. The Illinois State University Law is amended by adding Section 20-190 as follows:

Section 35. The Northeastern Illinois University Law is amended by adding Section 25-185 as follows:

Section 40. The Northern Illinois University Law is amended by adding Section 30-195 as follows:

Section 45. The Western Illinois University Law is amended by adding Section 35-190 as follows:

Section 50. The Public Community College Act is amended by adding Section 3-29.11 as follows:

Sec. 3-29.11. Athletic uniform and equipment reporting requirements.

(a) In this Section:

"Articles of clothing" means items worn to cover any part of the body, including without limitation headgear, sweatbands, socks, and footwear.

"Athletes" means students of a community college who participate in an interscholastic, college-sponsored, or college-supported athletic activity.

"Headgear" means a helmet, hat, or any other item worn on the head.

"Sports equipment" means any object needed to participate in an interscholastic, college-sponsored, or college-supported athletic activity, including without limitation a ball, disc, bat, stick, club, or racquet. "Sports equipment" does not include sports equipment that an athlete owns, unless the athlete is required to purchase a particular manufacturer's sports equipment.

(b) Each year, on or before October 1, a community college district shall report to the State Board all of the following information:

(1) The location of final assembly of those uniform articles of clothing athletes for a particular athletic activity are required to wear, whether during practice, during competition, or at any other time.

(2) The location of final assembly of sports equipment used by athletes.

(3) Whether a community college has entered into a contract to provide uniform articles of clothing or sports equipment under item (1) or (2) of this subsection (b), the parties to that contract, the duration of that contract, and the amount the community college must pay under that contract.

(4) The total amount a community college is paying for uniform articles of clothing or sports equipment under item (1) or (2) of this subsection (b).

(c) Each year, the State Board shall compile the information reported under subsection (b) of this Section and post that information on its Internet website on or before December 1.

The State Board may adopt any rules necessary to implement and administer this Section.

Section 99. Effective date. This Act takes effect upon becoming law.".
