1    AN ACT concerning State government.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Department of Commerce and Economic 
5Opportunity Law of the
Civil Administrative Code of Illinois is 
6amended  by adding Section 604-1020 as follows:
 
7    (20 ILCS 605/604-1020  new)
8    Sec. 604-1020. Credit and background checks and unpaid 
9child support study.
10    (a) Subject to appropriation, the Department shall conduct 
11a study regarding credit and background checks conducted by 
12public and private employers. The purpose of the study is to 
13determine what, if any, impact unpaid child support information 
14has on an individual's ability to be considered, interviewed, 
15and hired by an employer. The study shall focus on the 
16following:
17        (1) Whether credit and background checks reveal unpaid 
18    child support obligations, including, but not limited to, 
19    amounts in arrears, civil judgments, and criminal 
20    convictions for failure to pay child support.
21        (2) Whether the information revealed in a credit or 
22    background check regarding unpaid child support prevents 
23    applicants from gaining employment.

1    (b) The study may include data related to the prevalence of 
2information regarding unpaid child support on standard 
3employer credit and background checks, the prevalence of 
4criminal versus civil judgments on standard employer credit and 
5background checks, and the number of employers who utilize this 
6information when screening applicants for employment.
7    (c) The Department shall report the results of its study 
8and any recommendations to the Governor and the General 
9Assembly on or before May 1, 2016.
10    (d) This Section is repealed January 1, 2017.
 
 
11    Section 99. Effective date. This Act takes effect January 
121, 2015.
