AMENDMENT TO HOUSE BILL 4584

AMENDMENT NO. ______. Amend House Bill 4584 by replacing everything after the enacting clause with the following:

"Section 5. The Navigator Certification Act is amended by adding Section 22 as follows:

(215 ILCS 121/22 new)

Sec. 22. Criminal history record check; application for certificate and certificate renewal.

(a) For the purpose of this Section, "fingerprints" means an impression of the lines on the finger taken for the purpose of identification. The impression may be electronic or in ink converted to electronic format.

(b) In order to make a determination of certification eligibility, the Director is authorized to require all applicants for a certificate to undergo a fingerprint-based criminal history record check for an initial certificate and, for an individual holding a certificate on the effective date of this amendatory Act of the 98th General Assembly, for the first renewal of a certificate. The applicant shall submit his or her fingerprints to the Department of State Police in the form and manner prescribed by the Department of State Police. The fingerprints shall be transmitted by a live scan fingerprint vendor licensed by the Department of Financial and Professional Regulation. The fingerprints shall be checked against the fingerprint records filed in the Department of State Police and Federal Bureau of Investigation criminal history records databases. The Department of State Police shall charge a fee for conducting the criminal history record check, which shall be deposited in the State Police Services Fund and shall not exceed the actual cost of the State and national criminal history record check. The Department of State Police shall furnish, pursuant to positive identification, all Illinois conviction information to the Department of Insurance and shall forward the national criminal history record information to the Department of Insurance.".
