AMENDMENT TO HOUSE BILL 4910

AMENDMENT NO. ______. Amend House Bill 4910 by replacing everything after the enacting clause with the following:

"Section 5. The State Finance Act is amended by adding Section 5.855 as follows:

Sec. 5.855. The Advanced Manufacturing Technologies Fund.

Section 10. The Public Community College Act is amended by adding Section 3-53 as follows:

(110 ILCS 805/3-53 new)

Sec. 3-53. Certified private-public partnership boards.

(a) In this Section:

"Advanced manufacturing technology" means a program of study that leads students to an industry certification, diploma, degree, or combination of these in skills and competencies needed by manufacturers.

"Certified private-public partnership board" means a formal group of volunteers within a community college district that may be comprised of some, but not necessarily all, of the following: local and regional manufacturers, applicable labor unions, community college officials, school district superintendents, high school principals, workforce investment boards, or other individuals willing to participate.

"Industry certification" means an industry-recognized credential that is (i) industry created, (ii) nationally portable, (iii) third-party-validated by either the International Organization for Standardization or the American National Standards Institute and is data-based and supported.

"Institution" means a public high school or community college, including a community college in a community college district to which Article 7 of this Act applies, that offers instruction in advanced manufacturing technology for credit towards a degree.

(b) The creation of a certified private-public partnership board is encouraged and may be authorized at each community college.

(c) The Illinois Community College Board may certify private-public partnership boards that meet the requirements of this subsection (c). To become certified, a public-private partnership board shall:

(1) be minimally comprised of those entities described in subsection (a) of this Section;

(2) be led cooperatively by a manufacturer, a school district superintendent, and a community college president or their designees;

(3) meet no less than 4 times each year during State fiscal years 2015 and 2016 and thereafter no less than twice each State fiscal year;

(4) encourage and define the implementation of programs of study in advanced manufacturing technology to meet the competency and skill demands of manufacturers;

(5) define a minimum of 4 programs of study in advanced manufacturing technology to meet the needs of the broadest number of manufacturers in the area;

(6) encourage formal alignment and dual-credit opportunities for high school students who begin advanced manufacturing technology training to transition to community college programs of study in advanced manufacturing technology; and

(7) establish, as its foundation, the certified production technician credential offered by the Manufacturing Skill Standards Council or its successor entity.

(d) A certified private-public partnership board that annually meets the requirements of subsection (c) of this Section may be eligible for a budget stabilization factor for advanced manufacturing technology programs of study at participating institutions, subject to appropriation and funding, under the following conditions:

(1) The Illinois Community College Board may annually certify that each partnership meets the requirements of subsection (c) of this Section.

(2) When met and certified, there can be no reduction from the previous year's appropriation or elimination of appropriations for such advanced manufacturing technology programs, unless the Governor declares a funding emergency exists.

(3) The substantive committees of the General Assembly focusing on higher education may, by joint resolution, set the Governor's declaration aside.

(4) If the Governor's declaration is not set aside, the appropriation supporting advanced manufacturing technology programs of study may be reduced by no greater than 2% for the next State fiscal year.

Nothing in this subsection (d) may be construed to restrict the General Assembly from approving additional appropriations to support advanced manufacturing technology programs of study.

(e) Institutions may apply to the Illinois Community College Board for funds needed for purchasing equipment, software, or supplies to support advanced manufacturing technology programs of study that the institution is unable to sufficiently obtain through regular appropriations. Such support may not exceed $250,000 per institution for any State fiscal year. Only certified private-public partnership boards are eligible to make application for this support and must show the request meets unfunded needs to ensure alignment and success of the programs of study. This subsection (e) is subject to appropriation.

Any non-public entity participating in a private-public partnership as described in subsection (c) of this Section may make contributions to the Advanced Manufacturing Technologies Fund to be used in supporting advanced manufacturing technology programs of study. These contributions from non-public entities shall constitute the entirety of outside deposits into the Advanced Manufacturing Technologies Fund. The Advanced Manufacturing Technologies Fund may be created as a special fund in the State treasury, but no money from the General Revenue Fund, the Common School Fund, the Education Assistance Fund, or other funds within the custody of the State Treasurer may be appropriated or reappropriated to the Advanced Manufacturing Technologies Fund. All money in the Advanced Manufacturing Technologies Fund shall be used, subject to appropriation, by the Illinois Community College Board to support certified public-private partnership boards under this Section and may not be appropriated for any other use.

Cash contributions deposited into the Advanced Manufacturing Technologies Fund shall be considered charitable contributions for purposes of the Illinois Income Tax Act. Contributions consisting of new or certified used equipment, software, or other supplies shall also be considered charitable contributions for the purposes of the Illinois Income Tax Act, according to the value of the contribution.

(f) The Illinois Community College Board may submit an annual report to the Governor, the General Assembly, and the public on or before November 1 of each year describing the status of each private-public partnership board. The report may include the following:

(1) An accounting of the expenditures of any money from the Advanced Manufacturing Technologies Fund.

(2) Anticipated requests for money from the Advanced Manufacturing Technologies Fund for the upcoming State fiscal year.

(3) The number of credentials issued by institutions participating in private-public partnerships.

(4) Other such information that the Illinois Community College Board determines is appropriate.

(g) The Illinois Community College Board may adopt any rules necessary to carry out the purposes of this Section.

Section 99. Effective date. This Act takes effect upon becoming law.".
