Amends the Department of Public Health Powers and Duties Law of the
Civil Administrative Code of Illinois. Provides that the Department shall develop and implement a public education program to educate the public about the provisions of the Illinois Controlled Substances Act granting limited immunity from prosecution for drug overdose victims or persons seeking help for drug overdose victims if the only evidence for the possession charge was obtained as a result of the person seeking or obtaining emergency medical assistance.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Department of Public Health Powers and |

6 | | amended by adding Section 2310-685 as follows: |

8 | | Sec. 2310-685. Immunity from prosecution; drugs; public |
9 | | education program. The Department shall develop and implement a |
10 | | public education program to educate the public about the |
11 | | provisions set forth in Section 414 of the Illinois Controlled |
12 | | Substances Act, also referred to as the Good Samaritan Overdose |
13 | | Law, granting limited immunity from prosecution for drug |
14 | | overdose victims or persons seeking help for drug overdose |
15 | | victims if the only evidence for the possession charge was |
16 | | obtained as a result of the person seeking or obtaining |
17 | | emergency medical assistance.
