SYNOPSIS AS INTRODUCED:
 
205 ILCS 510/20

    Amends the Pawnbroker Regulation Act. Makes changes to the Section that creates the Precious Metals Purchasers Task Force. Provides that the task force shall file and present the report concerning its recommendations to the General Assembly on or before December 14, 2014 (rather than on or before December 14, 2013). Further provides that the Section is repealed on June 30, 2015 (rather than December 31, 2014). Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pawnbroker Regulation Act is amended by
5adding Section 20 as follows:
 
6    (205 ILCS 510/20)
7    (Section scheduled to be repealed on December 31, 2014)
8    Sec. 20. Precious Metal Purchasers Task Force.
9    (a) The General Assembly finds:
10        (1) There has been, and continues to be, a significant
11    expansion in the volume of precious metals and jewelry sold
12    through pawnbrokers, auction services, for-profit
13    consignment sellers, and other resellers.
14        (2) There has been, and continues to be, a similar
15    increase in the volume of stolen precious metals and
16    jewelry.
17        (3) Access by law enforcement to sales-related
18    information generated by pawnbrokers, auction services,
19    for-profit consignment sellers, and other resellers has
20    always been an important tool in combating burglary,
21    robbery, theft, and other crimes directed at personal
22    property.
23        (4) Recent advances in electronic data collection and

1    compilation have greatly simplified both the reporting of
2    sales-related information by pawnbrokers, auction
3    services, for-profit consignment sellers, and other
4    resellers.
5        (5) Law enforcement agencies, pawnbrokers, auction
6    services, for-profit consignment sellers, resellers, and
7    information technology-related businesses in several
8    states have created differing systems to provide law
9    enforcement with timely access to sales-related
10    information.
11    (b) There is hereby created the Precious Metal Purchasers
12Task Force, consisting of members appointed as follows:
13        (1) two members from the Senate, one appointed by the
14    Senate President and one appointed by the Minority Leader;
15        (2) two members from the House of Representatives, one
16    appointed by the Speaker of the House and one appointed by
17    the Minority Leader;
18        (3) one member appointed by the Governor as chairperson
19    of the task force;
20        (4) one member appointed by the Secretary of State;
21        (5) one member appointed by the Attorney General;
22        (6) one member appointed by the Secretary of Financial
23    and Professional Regulation from the Department of
24    Financial and Professional Regulation;
25        (7) one member appointed by the Director of State
26    Police from the Department of State Police;

1        (8) one member from a statewide organization
2    representing the Chiefs of Police appointed by the
3    Governor;
4        (9) one member recommended by the Illinois Municipal
5    League and appointed by the Governor;
6        (10) one member of an association representing the
7    interests of pawnbrokers appointed by the Governor;
8        (11) one member representing the interests of
9    for-profit consignment shops appointed by the Governor;
10        (12) one member representing the interests of the
11    insurance industry with a strong vested interest in
12    stopping theft and recovering stolen goods appointed by the
13    Governor;
14        (13) two members representing the interests of the
15    general public appointed by the Governor;
16        (14) one member representing the interests of the scrap
17    recycling industry appointed by the Governor;
18        (15) one member of a statewide association exclusively
19    representing retailers appointed by the Governor; and
20        (16) one member of an association representing
21    numismatic shops appointed by the Governor.
22    All members appointed under this Section shall serve
23without compensation, and may be reimbursed for their
24reasonable and necessary expenses from funds appropriated from
25the Pawnbroker Regulation Fund.
26    (c) The task force shall study the various systems,

1technologies, and methods of operation for providing law
2enforcement with the timely access to information relating to
3the sales of precious metals and jewelry by pawnbrokers,
4auction sellers, for-profit consignment sellers, resellers,
5and other persons or entities as it may deem fit, including,
6but not limited to, providers of technology and services
7relating to the collection, compilation, storage, and access to
8such information.
9    (d) The Department of Financial and Professional
10Regulation shall provide any necessary administrative and
11other support to the task force.
12    (e) On or before December 31, 2014 2013, the task force
13shall file and present a report to the General Assembly
14concerning its recommendations regarding the systems and
15technologies, together with their usage and potential funding
16mechanisms and sources, to be implemented to create a statewide
17system for the collection of information of the sales of
18precious metals and jewelry by pawnbrokers, auction services,
19for-profit consignment sellers, and other resellers, and for
20the compilation, storage, and timely access to that information
21by law enforcement and shall include proposed legislation to
22implement its recommendations, if needed.
23    (f) This Section is repealed on June 30, 2015 December 31,
242014.
