SYNOPSIS AS INTRODUCED:

Amends the following Acts and Codes to provide that, beginning in 2016, the entities created under those Acts and Codes shall adopt a uniform fiscal year beginning on July 1 and ending on June 30: Emergency Telephone System Act, Airport Authorities Act, Cemetery Maintenance District Act, Civic Center Code, Soil and Water Conservation Districts Act, Illinois Drainage Code, Fire Protection District Act, Downstate Forest Preserve District Act, Public Health District Act, Hospital District Law, Tuberculosis Sanitarium District Act, Mosquito Abatement District Act, Museum District Act, Park District Code, Illinois International Port District Act, Railroad Terminal Authority Act, Rescue Squad Districts Act, River Conservancy Districts Act, Sanitary District Act of 1907, North Shore Sanitary District Act, Sanitary District Act of 1917, Sanitary District Act of 1936, Metro-East Sanitary District Act of 1974, Street Light District Act, Surface Water Protection District Act, Prairie Trail Authority Act, Local Mass Transit District Act, Public Water District Act, Water Service District Act, Water Authorities Act, and Water Commission Act of 1985. Allows the above entities with fiscal years ending on a date other than June 30 to adopt appropriation ordinances for a transition period of less than 12 months as may be necessary to effect the change. Provides that appropriations made for the transition period shall end with the close of the transition period. Effective immediately.

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Emergency Telephone System Act is amended by adding Section 18 as follows:

Sec. 18. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the local agency systems and Boards shall end on June 30. Thereafter, the fiscal year of the local agency systems and Boards shall commence on July 1 and end on June 30.

(b) If the fiscal year of the local agency systems and Boards ends on a date other than June 30, the local agency systems and Boards shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 10. The Airport Authorities Act is amended by adding Section 6.5 as follows:

Sec. 6.5. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the authority shall end on June 30. Thereafter, the fiscal year of the authority shall commence on July 1 and end on June 30.

(b) If the fiscal year of the authority ends on a date other than June 30, the authority shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 15. The Cemetery Maintenance District Act is amended by adding Section 13 as follows:

Sec. 13. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 20. The Civic Center Code is amended by adding Section 2-134 as follows:

Sec. 2-134. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the authority shall end on June 30. Thereafter, the fiscal year of the authority shall commence on July 1 and end on June 30.

(b) If the fiscal year of the authority ends on a date other than June 30, the authority shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

(c) Notwithstanding the provisions of Section 2-1 of this Code, the provisions of this Section apply to all authorities created under this Code.

Section 25. The Soil and Water Conservation Districts Act is amended by adding Section 43 as follows:

Sec. 43. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 30. The Illinois Drainage Code is amended by adding Section 1-8 as follows:

Sec. 1-8. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 35. The Fire Protection District Act is amended by adding Section 16.19 as follows:

Sec. 16.19. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 40. The Downstate Forest Preserve District Act is amended by adding Section 13.9 as follows:

Sec. 13.9. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 45. The Public Health District Act is amended by adding Section 26 as follows:

Sec. 26. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 50. The Hospital District Law is amended by adding Section 14.5 as follows:

Sec. 14.5. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 55. The Tuberculosis Sanitarium District Act is amended by adding Section 15 as follows:

Sec. 15. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 60. The Mosquito Abatement District Act is amended by adding Section 9.2 as follows:

Sec. 9.2. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 65. The Museum District Act is amended by changing Section 20 as follows:

Sec. 20. Fiscal year and appropriation ordinances. (a) The board shall fix a fiscal year for the district. The board shall, within or before the first quarter of each fiscal year, adopt an annual appropriation ordinance appropriating the sums of money that will be required to defray all necessary expenses and liabilities of the district to be paid or incurred during the fiscal year.

(b) The failure of the board to adopt an annual appropriation ordinance or to otherwise comply with the provisions of this Section shall not affect the validity of any tax levy of the district. The annual appropriation ordinance for any fiscal year need not be intended or required to be in support of or in relation to any tax levy made during that fiscal year.

(b-5) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(c) If the fiscal year of the district ends on a date other than June 30, to fulfill the requirements of subsection (b-5) of this Section, the district shall A district that determines to change its fiscal year may adopt an appropriation ordinance for a transition period of more or less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 70. The Park District Code is amended by adding Section 4-5 as follows:

Sec. 4-5. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 75. The Illinois International Port District Act is amended by adding Section 23 as follows:

Sec. 23. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 80. The Railroad Terminal Authority Act is amended by adding Section 30 as follows:

Sec. 30. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the authority shall end on June 30. Thereafter, the fiscal year of the authority shall commence on July 1 and end on June 30.

(b) If the fiscal year of the authority ends on a date other than June 30, the authority shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 85. The Rescue Squad Districts Act is amended by adding Section 12.5 as follows:

Sec. 12.5. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 90. The River Conservancy Districts Act is amended by adding Section 29 as follows:

Sec. 29. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 95. The Sanitary District Act of 1907 is amended by adding Section 30 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

Appropriations made for the transition period shall end with the close of the transition period.

Section 100. The North Shore Sanitary District Act is amended by adding Section 31 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 105. The Sanitary District Act of 1917 is amended by adding Section 32 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

Appropriations made for the transition period shall end with the close of the transition period.

Section 110. The Sanitary District Act of 1936 is amended by adding Section 94 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 115. The Metro-East Sanitary District Act of 1974 is amended by adding Section 3-9 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

Appropriations made for the transition period shall end with the close of the transition period.

Section 120. The Street Light District Act is amended by adding Section 11 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

Appropriations made for the transition period shall end with the close of the transition period.

Section 125. The Surface Water Protection District Act is amended by adding Section 25 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 130. The Prairie Trail Authority Act is amended by adding Section 7 as follows:

(a) Beginning in the year 2016, the fiscal year of the authority shall end on June 30. Thereafter, the fiscal year of the authority shall commence on July 1 and end on June 30.

Appropriations made for the transition period shall end with the close of the transition period.

Section 135. The Local Mass Transit District Act is amended by adding Section 7.5 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 140. The Public Water District Act is amended by adding Section 13.5 as follows:

(a) Beginning in the year 2016, the fiscal year of the district shall end on June 30. Thereafter, the fiscal year of the district shall commence on July 1 and end on June 30.

(b) If the fiscal year of the district ends on a date other than June 30, the district shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 145. The Water Service District Act is amended by adding Section 13 as follows:

Appropriations made for the transition period shall end with the close of the transition period.

Section 150. The Water Authorities Act is amended by adding Section 28 as follows:

Sec. 28. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the authority shall end on June 30. Thereafter, the fiscal year of the authority shall commence on July 1 and end on June 30.

(b) If the fiscal year of the authority ends on a date other than June 30, the authority shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 155. The Water Commission Act of 1985 is amended by adding Section 6 as follows:

Sec. 6. Fiscal year.

(a) Beginning in the year 2016, the fiscal year of the commission shall end on June 30. Thereafter, the fiscal year of the commission shall commence on July 1 and end on June 30.

(b) If the fiscal year of the commission ends on a date other than June 30, the commission shall adopt an appropriation ordinance for a transition period of less than 12 months as may be necessary to effect the change. Appropriations made for the transition period shall end with the close of the transition period.

Section 999. Effective date. This Act takes effect upon becoming law.
