AMENDMENT TO SENATE BILL 579

2    AMENDMENT NO. ______. Amend Senate Bill 579 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Sections
52-3.62 and 3-0.01 as follows:
 
6    (105 ILCS 5/2-3.62)  (from Ch. 122, par. 2-3.62)
7    Sec. 2-3.62. Educational Service Centers.
8    (a) A regional network of educational service centers shall
9be established by the State Board of Education to coordinate
10and combine existing services in a manner which is practical
11and efficient and to provide new services to schools as
12provided in this Section. Services to be made available by such
13centers shall include the planning, implementation and
14evaluation of:
15        (1) (blank);
16        (2) computer technology education;

1        (3) mathematics, science and reading resources for
2    teachers including continuing education, inservice
3    training and staff development.
4    The centers may provide training, technical assistance,
5coordination and planning in other program areas such as school
6improvement, school accountability, financial planning,
7consultation, and services, career guidance, early childhood
8education, alcohol/drug education and prevention, family life -
9 sex education, electronic transmission of data from school
10districts to the State, alternative education and regional
11special education, and telecommunications systems that provide
12distance learning. Such telecommunications systems may be
13obtained through the Department of Central Management Services
14pursuant to Section 405-270 of the Department of Central
15Management Services Law (20 ILCS 405/405-270). The programs and
16services of educational service centers may be offered to
17private school teachers and private school students within each
18service center area provided public schools have already been
19afforded adequate access to such programs and services.
20    Upon the abolition of the office, removal from office,
21disqualification for office, resignation from office, or
22expiration of the current term of office of the regional
23superintendent of schools, whichever is earlier, the chief
24administrative officer of the centers serving that portion of a
25Class II county school unit outside of a city of 500,000 or
26more inhabitants shall have and exercise, in and with respect

1to each educational service region having a population of
22,000,000 or more inhabitants and in and with respect to each
3school district located in any such educational service region,
4all of the rights, powers, duties, and responsibilities
5theretofore vested by law in and exercised and performed by the
6regional superintendent of schools for that area under the
7provisions of this Code or any other laws of this State.
8    The State Board of Education shall promulgate rules and
9regulations necessary to implement this Section. The rules
10shall include detailed standards which delineate the scope and
11specific content of programs to be provided by each Educational
12Service Center, as well as the specific planning,
13implementation and evaluation services to be provided by each
14Center relative to its programs. The Board shall also provide
15the standards by which it will evaluate the programs provided
16by each Center.
17    (b) Centers serving Class 1 county school units shall be
18governed by an 11-member board, 3 members of which shall be
19public school teachers nominated by the local bargaining
20representatives to the appropriate regional superintendent for
21appointment and no more than 3 members of which shall be from
22each of the following categories, including but not limited to
23superintendents, regional superintendents, school board
24members and a representative of an institution of higher
25education. The members of the board shall be appointed by the
26regional superintendents whose school districts are served by

1the educational service center. The composition of the board
2will reflect the revisions of this amendatory Act of 1989 as
3the terms of office of current members expire.
4    (c) The centers shall be of sufficient size and number to
5assure delivery of services to all local school districts in
6the State.
7    (d) From monies appropriated for this program the State
8Board of Education shall provide grants paid from the Personal
9Property Tax Replacement Fund to qualifying Educational
10Service Centers applying for such grants in accordance with
11rules and regulations promulgated by the State Board of
12Education to implement this Section.
13    (e) The governing authority of each of the 18 regional
14educational service centers shall appoint a family life - sex
15education advisory board consisting of 2 parents, 2 teachers, 2
16school administrators, 2 school board members, 2 health care
17professionals, one library system representative, and the
18director of the regional educational service center who shall
19serve as chairperson of the advisory board so appointed.
20Members of the family life - sex education advisory boards
21shall serve without compensation. Each of the advisory boards
22appointed pursuant to this subsection shall develop a plan for
23regional teacher-parent family life - sex education training
24sessions and shall file a written report of such plan with the
25governing board of their regional educational service center.

1centers shall thereupon meet, review each of the reports
2submitted by the advisory boards and combine those reports into
3a single written report which they shall file with the Citizens
4Council on School Problems prior to the end of the regular
5school term of the 1987-1988 school year.
6    (f) The 14 educational service centers serving Class I
7county school units shall be disbanded on the first Monday of
8August, 1995, and their statutory responsibilities and
9programs shall be assumed by the regional offices of education,
10subject to rules and regulations developed by the State Board
11of Education. The regional superintendents of schools elected
12by the voters residing in all Class I counties shall serve as
13the chief administrators for these programs and services. By
14rule of the State Board of Education, the 10 educational
15service regions of lowest population shall provide such
16services under cooperative agreements with larger regions.

19    Sec. 3-0.01. "County superintendent of schools" and
20"regional superintendent of schools" defined - Application of
21Article.
22    (a) Except as otherwise provided by subsection (b), after
23the effective date of this amendatory Act of 1975, the chief
24administrative officer of an educational service region shall
25be designated and referred to as the "regional superintendent

1of schools" or the "regional superintendent" and after the
2effective date of this amendatory Act of 1993 the office held
3by the chief administrative officer shall be designated and
4referred to as the "regional office of education". For purposes
5of the School Code and except as otherwise provided by
6subsection (b), any reference to "county superintendent of
7schools" or "county superintendent" means the regional
8superintendent of schools.
9    (b) Notwithstanding any other provisions of this Article,
10but subject to subsection (b-1), in educational service regions
11containing 2,000,000 or more inhabitants, the office of
12regional superintendent of schools is abolished. Subject to
13Section 2-3.105 of this Code, beginning on July 1, 2010 (the
14effective date of Public Act 96-893) this amendatory Act of the
1596th General Assembly, all rights, powers, duties and
16responsibilities theretofore vested by law in, and exercised
17and performed by the regional superintendent of schools and by
18any assistant regional superintendents or other assistants or
19employees in the office of the regional superintendent of
20schools being abolished shall be vested in, exercised and
21performed by the chief administrative officer of the
22educational service centers established pursuant to Section
232-3.62 of this Code for any educational service region
24containing 2,000,000 or more inhabitants. Beginning on the
25effective date of this amendatory Act of the 96th General
26Assembly, in an educational service region containing

12,000,000 or more inhabitants: (i) all books, records, maps,
2papers and other documents belonging to or subject to the
3control or disposition of the former regional superintendent of
4schools by virtue of his office shall be transferred and
5delivered to the State Board of Education; (ii) possession or
6control over all moneys, deposits and accounts in the
7possession or subject to the control or disposition of the
8former regional superintendent of schools by virtue of his
9office, including but not limited to undistributed or
10unexpended moneys drawn from, and all amounts on deposit in,
11the county, institute and supervisory expense funds, shall be
12transferred to and placed under the control and disposition of
13the State Board of Education, excepting only those moneys or
14accounts, if any, the source of which is the county treasury,
15for proper redistribution to the educational service centers;
16and (iii) all other equipment, furnishings, supplies and other
17personal property belonging to or subject to the control or
18disposition of the former regional superintendent of schools by
19virtue of his office, excepting only those items which were
20provided by the county board, shall be transferred and
21delivered to the State Board of Education. Beginning on July 1,
222010 (the effective date of Public Act 96-893) this amendatory
23Act of the 96th General Assembly, any reference in this Code to
24"regional superintendent of schools" or "regional
25superintendent", or "county superintendent of schools" or
26"county superintendent" shall mean, with respect to any

1educational service region containing 2,000,000 or more
2inhabitants in which the office of regional superintendent of
3schools is abolished, the chief administrative officer of the
4educational service centers established pursuant to Section
52-3.62 of this Code for the educational service region. Upon
6and after the first Monday of August 1995, references in this
7Code and elsewhere to educational service regions of 2,000,000
8or fewer inhabitants shall exclude any educational service
9region containing a city of 500,000 or more inhabitants and
10references in this Code and elsewhere to educational service
11regions of 2,000,000 or more inhabitants shall mean an
12educational service region containing a city of 500,000 or more
13inhabitants regardless of the actual population of the region.
14    (b-1) References to "regional superintendent" shall also
15include the chief administrative officer of the educational
16service centers established under Section 2-3.62 of this Code
17and serving that portion of a Class II county outside a city of
18500,000 or more population elected at the general election in
191994 and every 4 years thereafter.
20    (c) This Article applies to the regional superintendent of
21a multicounty educational service region formed under Article
223A as well as to a single county or partial county region,
23except that in case of conflict between the provisions of this
24Article and of Article 3A in the case of a multicounty region,
25the provisions of Article 3A shall apply. Any reference to
26"county" or to "educational service region" in this Article
