AMENDMENT TO SENATE BILL 1344 




2    AMENDMENT NO. ______. Amend Senate Bill 1344 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Downstate Forest Preserve District Act is 
5amended  by adding Section 18.1a as follows:
 
6    (70 ILCS 805/18.1a new)
7    Sec. 18.1a. Forest preserve mining operations.
8    (a) No land that is owned or acquired by a forest preserve 
9district may be used for the development or operation of any 
10new sand, gravel, or other mining operation. 
11    (b) A forest preserve district may not transfer any land or 
12interest in land acquired by the district to any other entity 
13that the district has reason to know intends to construct any 
14new sand, gravel, or other mining operation.
15    A  forest preserve district that wishes to transfer any land 
16or interest in land owned or acquired by the district to any

1other entity must impose, as a condition of the transfer, a 
2covenant prohibiting the development of any new sand, gravel, 
3or other mining operation. 
4    (c) Lands owned or acquired by a forest preserve district 
5that were previously mined, or are actively being mined at the 
6time of acquisition, are exempt from this provision.
7    (d) This Section shall apply only to land purchased by 
8referendum.".
