Amends the Humane Care for Animals Act. If the Department of Agriculture determines that a complaint made under the Act against a person or entity is false or unfounded and made with the intent to harass the person or entity, the Department may waive any confidentiality of the complainant and refer the matter to the State's Attorney for consideration of criminal charges against the complainant. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Humane Care for Animals Act is amended by |
5 | | adding Section 19 as follows: |
6 | | (510 ILCS 70/19 new) |
7 | | Sec. 19. False complaints. If the Department determines |
8 | | that a complaint made under this Act against a person or entity |
9 | | is false or unfounded and made with the intent to harass the |
10 | | person or entity, the Department may waive any confidentiality |
11 | | of the complainant and refer the matter to the State's Attorney |
12 | | for consideration of criminal charges against the complainant.

13 | | Section 99. Effective date. This Act takes effect upon |
14 | | becoming law.
