AMENDMENT TO SENATE BILL 1618 




2    AMENDMENT NO. ______. Amend Senate Bill 1618 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Abused and Neglected Child Reporting Act is 
5amended  by adding Section 4.03 as follows:
 
6    (325 ILCS 5/4.03 new)
7    Sec. 4.03. Reporting acts of sexual abuse against a minor.
8    (a) For the purposes of this Section:
9        "Minor" means any person under the age of 18.
10        "Sexual abuse" means criminal sexual assault, 
11    aggravated criminal sexual assault,
predatory criminal 
12    sexual assault of a child, criminal sexual abuse, 
13    aggravated criminal sexual abuse, or sexual exploitation 
14    of a
child as defined in subsection (a-5) of Section 11-9.l 
15    of the Criminal Code of 2012.
16    (b)  Any person over the age of 18 who witnesses the

1commission of an act that he or she
reasonably believes to be 
2an act of sexual abuse against a minor and who willfully fails 
3to report the
act to local law enforcement is guilty of a Class 
4A misdemeanor for a first violation and a Class 4
felony for a 
5second or subsequent violation.".
