| 1 | AN ACT concerning public employee benefits.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Pension Code is amended by changing | ||||||
| 5 | Sections 9-112 and 9-190 and adding Sections 9-119.1 and | ||||||
| 6 | 9-202.1 as follows:
| ||||||
| 7 | (40 ILCS 5/9-112) (from Ch. 108 1/2, par. 9-112)
| ||||||
| 8 | Sec. 9-112. Salary. "Salary": Annual salary of an employee | ||||||
| 9 | under this Article as follows:
| ||||||
| 10 | (a) Beginning on the effective date and prior to July 1, | ||||||
| 11 | 1947 $3000
shall be the maximum amount of annual salary of any | ||||||
| 12 | employee to be
considered for the purposes of this Article; and | ||||||
| 13 | beginning on July 1,
1947 and prior to July 1, 1953, said | ||||||
| 14 | maximum amount shall be $4800; and
beginning on July 1, 1953 | ||||||
| 15 | and prior to July 1, 1957 said maximum amount
shall be $6,000; | ||||||
| 16 | and beginning on July 1, 1957, if salary shall be based upon | ||||||
| 17 | the actual sum paid and reported to the Fund or wages is
| ||||||
| 18 | appropriated, fixed or arranged on an annual basis, the actual | ||||||
| 19 | sum
payable during the year if the employee worked the full | ||||||
| 20 | normal working
time in his position, at the rate of | ||||||
| 21 | compensation, exclusive of
overtime and extra service. , | ||||||
| 22 | appropriated or fixed as salary or wages for service in the
| ||||||
| 23 | position;
| ||||||

| 1 | (b) (Blank). Beginning July 1, 1957, if appropriated, fixed | ||||||
| 2 | or arranged on
other than an annual basis, the applicable | ||||||
| 3 | schedules specified in
Section 9-221 shall be used for | ||||||
| 4 | conversion of the salary to an annual
basis;
| ||||||
| 5 | (c) Where the county provides lodging, board and laundry | ||||||
| 6 | service for
an employee without charge and so reports to the | ||||||
| 7 | Fund while the employee is receiving such lodging, board and | ||||||
| 8 | laundry service, his salary shall be considered to be $480 a
| ||||||
| 9 | year more for the period from the effective date to August 1, | ||||||
| 10 | 1959 and
thereafter $960 more than the amount payable as salary | ||||||
| 11 | for the year, and
the salary of an employee for whom one or | ||||||
| 12 | more daily meals are provided
by the county without charge | ||||||
| 13 | therefor and are reported by the county to the Fund while the | ||||||
| 14 | employee is receiving such meals shall be considered to be $120 | ||||||
| 15 | a
year more for each such daily meal for the period from the | ||||||
| 16 | effective
date to August 1, 1959 and thereafter $240 more for | ||||||
| 17 | each such daily meal
than the amount payable as his salary for | ||||||
| 18 | the year.
| ||||||
| 19 | (d) For the purposes of ordinary disability, salary shall | ||||||
| 20 | be based upon the rate reported to the Fund at the date of | ||||||
| 21 | disability and adjusted to reflect the actual hours paid during | ||||||
| 22 | the prior year. | ||||||

| 25 | Sec. 9-119.1. Earned annuity. "Earned annuity": (1) The | ||||||

| 1 | annuity a participant has accrued as provided in Section 9-134, | ||||||
| 2 | disregarding minimum age and service eligibility requirements | ||||||
| 3 | and without any reduction due to age, or (2) the age and | ||||||
| 4 | service annuity as provided in Sections 9-125 through 9-128, | ||||||
| 5 | inclusive.

| 7 | Sec. 9-190. Board powers and duties. The board shall have | ||||||
| 8 | the powers and duties stated in Sections 9-191 to
9-202.1 | ||||||
| 9 | 9-202, inclusive, in addition to such other powers and duties | ||||||
| 10 | provided in
this Article.

| 13 | Sec. 9-202.1. To reproduce records. To have any records | ||||||
| 14 | kept by the board photographed, microfilmed, or digitally or | ||||||
| 15 | electronically reproduced in accordance with the Local Records | ||||||
| 16 | Act. The photographs, microfilm, and digital and electronic | ||||||
| 17 | reproductions shall be deemed original records and documents | ||||||
| 18 | for all purposes, including introduction in evidence before all | ||||||
| 19 | courts and administrative agencies. | ||||||

| 21 | Section 10. The Illinois Pension Code is amended by | ||||||
| 22 | repealing Section 9-221.
| ||||||
| 23 | Section 99. Effective date. This Act takes effect upon | ||||||
