| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2658 on page 1, by |
| 3 | | replacing lines 12 through 18 with the following:

| 4 | | "Sec. 7-202.23. Treatment or removal of elm trees infected |
| 5 | | with Dutch elm disease or ash trees infected with the emerald |
| 6 | | ash borer (Agrilus planipennis Fairmaire) from any parcel of |
| 7 | | public property within the municipality. Municipalities may |
| 8 | | use motor fuel tax funds under the general maintenance program |
| 9 | | for the treatment or removal of ash trees if the following |
| 10 | | criteria are met: |
| 11 | | (a) the municipality is located in the emerald ash borer |
| 12 | | quarantine zone published by the Illinois Department of |
| 13 | | Agriculture; |
| 14 | | (b) the ash trees are located on the public right-of-way or |
| 15 | | are a potential hazard to vehicle travel; |
| 16 | | (c) the ash trees to be removed are shown in a detailed |
| 17 | | inventory; and |
