AMENDMENT TO SENATE BILL 2809 




2    AMENDMENT NO. ______. Amend Senate Bill 2809, AS AMENDED, 
3by replacing everything after the enacting clause with the 
4following:

 
5    "Section 5. The Illinois Pension Code is amended  by 
6changing Section 1-115 as follows:
 



7    (40 ILCS 5/1-115)  (from Ch. 108 1/2, par. 1-115)



8    Sec. 1-115. Civil Enforcement. A civil action may be 
9brought by the
Attorney General or by a participant, 
10beneficiary or fiduciary in order to:

11    (a) Obtain appropriate relief under Section 1-114 of this 
12Code;

13    (b) Enjoin any act or practice which violates any provision 
14of this Code; or

15    (c) Obtain other appropriate equitable relief to redress 
16any such violation
or to enforce any such provision.

1    Notwithstanding any other provision of the Administrative 
2Review Law or this Code to the contrary, a civil action may be 
3brought by the Attorney General to enjoin the payment of 
4benefits under this Code to any person who is convicted of any 
5felony relating to or arising out of or in connection with that 
6person's service as an employee under this Code.
