AMENDMENT TO SENATE BILL 3275 




2    AMENDMENT NO. ______. Amend Senate Bill 3275 on page l, by 
3inserting immediately below line 3 the following:



 
4    "Section 1. Short title. This Act may be cited as the 
5Kratom Control Act.
 
6    Section 5. Kratom sale to or possession by minors 
7prohibited. 
8    (a) As used in this Act, "Kratom" means any parts of the 
9plant Mitragyna
speciosa, whether growing or not, and any 
10compound, manufacture, salt, derivative,
mixture, or 
11preparation of that plant, including but not limited to 
12mitragynine and 7-hydroxymitragynine.
13    (b) A minor under 18 years of age shall not knowingly 
14purchase or possess any product containing any
quantity of 
15Kratom.
16    (c) A minor under 18 years of age in the furtherance or

1facilitation of obtaining any product
containing Kratom shall 
2not knowingly display or  use a false or forged identification 
3card or transfer,
alter, or deface an identification card.
4    (d) A person shall not knowingly sell, buy for, distribute 
5samples of, or furnish any product containing any
quantity of 
6Kratom to any minor under 18 years of age.
7    (e) Sentence.   Violation of subsection (b) or (c) of this 
8Section is a Class B misdemeanor. Violation of subsection (d) 
9of this Section  is
a Class B misdemeanor for which the offender 
10shall be fined an amount of not less than $500."; and


 
11on page 1, line 4, by renumbering "Section 5" as "Section 105"; 
12and
 
13on page 13, line 1, by replacing "." with ";"; and
 
14on page 13, by inserting immediately below line 1 the 
15following:
16        "(57) 4-chloro-2,5-dimethoxy-N-[(2-methoxyphenyl) 
17    methyl]-benzeneethanamine (trade or other name: 
1825C-NBOMe); 
19        (58)  4-bromo-2,5-dimethoxy-N-[(2-methoxyphenyl) 
20    methyl]-benzeneethanamine (trade or other name:
21    25B-NBOMe).".
