AMENDMENT TO HOUSE BILL 205

AMENDMENT NO. ______. Amend House Bill 205 as follows:

on page 1, immediately below line 3, by inserting the following:

"Section 1. The Department of Human Services Act is amended by adding Section 10-61 as follows:

(20 ILCS 1305/10-61 new)

Sec. 10-61. Community mental health centers; income verification. The Department shall not require community mental health centers participating in the Medicaid community mental health services program established under 59 Ill. Adm. Code 132 to require recipients of medical assistance under Article V of the Illinois Public Aid Code to provide documentation of income.

Section 10. The Community Services Act is amended by adding Section 4.9 as follows:

(405 ILCS 30/4.9 new)

Sec. 4.9. Mental health professional; definition. As used in 59 Ill. Adm. Code 132, "mental health professional" or "MHP" means an individual who provides services under the supervision of a qualified mental health professional and who possesses: a bachelor's degree; a practical nurse license under the Nurse Practice Act; a certificate of psychiatric rehabilitation from a program approved by the Department of Human Services plus a high school diploma or high school equivalency certificate plus 2 years' experience in providing mental health services; a recovery support specialist certificate from, and in good standing with, the Illinois Alcohol and Other Drug Abuse Professional Certification Association, Inc.; a family partnership professional certificate from, and in good standing with, the Illinois Alcohol and Other Drug Abuse Professional Certification Association, Inc.; an occupational therapy assistant license under the Illinois Occupational Therapy Practice Act with at least one year of experience in a mental health setting; or a minimum of a high school diploma or high school equivalency certificate and 5 years' supervised clinical experience in mental health or human services. A supervised internship in a mental health setting counts toward the experience in providing mental health services. An individual meeting the minimum credentials for a Licensed Practitioner of the Healing Arts or Qualified Mental Health Professional as defined by the Department of Human Services, by rule, is deemed to also meet the credentialing requirements of a mental health professional. Any individual employed as a mental health professional before July 1, 2013 may continue to be so designated unless employment changes.".
