AMENDMENT TO HOUSE BILL 263

2    AMENDMENT NO. ______. Amend House Bill 263 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Park District Aquarium and Museum Act is
5amended by changing Section 1 and by adding Section 3 as
6follows:
 
7    (70 ILCS 1290/1)  (from Ch. 105, par. 326)
8    Sec. 1. Erect, operate, and maintain aquariums and museums.
9The corporate authorities of cities and park districts having
10the control or supervision of any public park or parks, are
11hereby authorized to purchase, erect and maintain within any
12public park or parks under the control or supervision of such
13corporate authorities, edifices to be used as aquariums or as
14museums of art, industry, science or natural or other history,
15or to permit the directors or trustees of any corporation or
16society organized for the construction or maintenance and

1operation of an aquarium or museum as hereinabove described to
2erect, enlarge, ornament, build, rebuild, rehabilitate,
3improve, maintain and operate its aquarium or museum or museums
4within any public park now or hereafter under the control or
5supervision of any city or park district, and to contract with
6any such directors or trustees of any such aquarium, museum or
7museums relative to the erection, enlargement, ornamentation,
8building, rebuilding, rehabilitation, improvement, maintenance
9and operation thereof. Any city or park district may charge, or
10permit such an aquarium or museum to charge, an admission fee.
11Any such aquarium or museum, however, shall be open without
12charge, when accompanied by a teacher, to the children in
13actual attendance upon grades kindergarten through twelve in
14any of the schools in this State at all times. For a period of 3
15years beginning on the effective date of this amendatory Act of
16the 99th General Assembly, any Any such aquarium or museum,
17however, must be open to persons who reside in this State
18without charge for a period equivalent to: (i) for persons 23
19years of age and younger, 52 days, at least 6 of which must be
20during the period from June through August, each year; and (ii)
21for persons older than 23 years of age, 26 days, at least 6 of
22which must be during the period from June through August, each
23year. Notwithstanding said provisions, charges may be made at
24any time for special services and for admission to special
25facilities within any aquarium or museum for the education,
26entertainment or convenience of visitors. The proceeds of such

1admission fees and charges for special services and special
2facilities shall be devoted exclusively to the purposes for
3which the tax authorized by Section 2 hereof may be used. If
4any owner or owners of any lands or lots abutting or fronting
5on any such public park, or adjacent thereto, have any private
6right, easement, interest or property in such public park
7appurtenant to their lands or lots or otherwise, which would be
8interfered with by the erection and maintenance of any aquarium
9or museum as hereinbefore provided, or any right to have such
10public park remain open or vacant and free from buildings, the
11corporate authorities of the city or park district having
12control of such park, may condemn the same in the manner
13prescribed for the exercise of the right of eminent domain
14under the Eminent Domain Act.

17    Sec. 3. Illinois Arts Commission. The Illinois Arts
18Commission is hereby created to work with the Illinois Arts
19Council to create a sustainability plan that emphasizes the
20diversity of patrons and works towards finding resources to
21sustain funding for museums, the arts, community art
22initiatives, and art programs in schools. The Commission shall
23consist of the following members to be appointed by the
24Illinois Arts Council and the Chairperson of the House Museums,
25Arts & Cultural Enhancement Committee within 90 days of the

1effective date of this amendatory Act:
2        (1) Four members of the General Assembly from the
3    majority caucus.
4        (2) Four members of the General Assembly from the
5    minority caucus.
6        (3) Three members of the public who are engaged in
7    community arts programs.
8    One member shall be designated by the appointing
9authorities as the chairperson of the Commission. Members of
10the Commission shall serve without compensation. The Illinois
11Arts Council shall provide staff or other resources necessary
12to support the Commission. Beginning on July 1, 2016, and by
13the beginning of every other fiscal year thereafter, the
14Commission shall submit a report to the General Assembly
15detailing its findings and recommendations.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
