1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 8-101 as follows:
 
6    (625 ILCS 5/8-101)  (from Ch. 95 1/2, par. 8-101)
7    Sec. 8-101. Proof of financial responsibility - Persons who
8operate motor vehicles in transportation of passengers for
9hire.
10    (a) It is unlawful for any person, firm or corporation to
11operate any motor vehicle along or upon any public street or
12highway in any incorporated city, town or village in this State
13for the carriage of passengers for hire, accepting and
14discharging all such persons as may offer themselves for
15transportation unless such person, firm or corporation has
16given, and there is in full force and effect and on file with
17the Secretary of State of Illinois, proof of financial
18responsibility provided in this Act.
19    (b) In addition this Section shall also apply to persons,
20firms or corporations who are in the business of providing
21transportation services for minors to or from educational or
22recreational facilities, except that this Section shall not
23apply to public utilities subject to regulation under "An Act

1concerning public utilities," approved June 29, 1921, as
2amended, or to school buses which are operated by public or
3parochial schools and are engaged solely in the transportation
4of the pupils who attend such schools.
5    (c) This Section also applies to a contract carrier
6transporting employees in the course of their employment on a
7highway of this State in a vehicle designed to carry 15 or
8fewer passengers. As part of proof of financial responsibility,
9a contract carrier transporting employees, including but not
10limited to railroad employees, in the course of their
11employment is required to verify hit and run and uninsured
12motor vehicle coverage, as provided in Section 143a of the
13Illinois Insurance Code, and underinsured motor vehicle
14coverage, as provided in Section 143a-2 of the Illinois
15Insurance Code, in a total amount of not less than $500,000
16$250,000 per passenger beginning on January 1, 2016, and not
17less than $750,000 per passenger on and after January 1, 2020.
18    (d) This Section shall not apply to any person
19participating in a ridesharing arrangement or operating a
20commuter van, but only during the performance of activities
21authorized by the Ridesharing Arrangements Act.
22    (e) If the person operating such motor vehicle is not the
23owner, then proof of financial responsibility filed hereunder
24must provide that the owner is primarily liable.
