| 1 | AMENDMENT TO HOUSE BILL 478

| 2 | AMENDMENT NO. ______. Amend House Bill 478 by replacing | ||||||
| 3 | everything after the enacting clause with the following: | ||||||
| 4 | "Section 5. The Counties Code is amended by changing | ||||||
| 5 | Section 5-44010 and by adding Section 5-44060 as follows: | ||||||
| 6 | (55 ILCS 5/5-44010) | ||||||
| 7 | Sec. 5-44010. Applicability. The powers and authorities | ||||||
| 8 | provided by this Division 5-44 apply to all counties within the | ||||||
| 9 | State only to counties with a population of more than 900,000 | ||||||
| 10 | and less than 3,000,000 that are contiguous to a county with a | ||||||
| 11 | population of more than 3,000,000 and units of local government | ||||||
| 12 | within such counties.

| 15 | Sec. 5-44060. Rights of former employees. On the effective | ||||||

| 1 | date of dissolution, the employees of the former unit of local | ||||||
| 2 | government shall be transferred to the governmental unit | ||||||
| 3 | assuming the functions of the former unit of local government. | ||||||
| 4 | The status and rights of employees represented by an exclusive | ||||||
| 5 | bargaining representative shall not be affected by any | ||||||
| 6 | consolidation. Obligations assumed by the government unit | ||||||
| 7 | assuming the functions of the former governmental unit shall | ||||||
| 8 | include the obligation to honor existing representation rights | ||||||
| 9 | under the Illinois Public Labor Relations Act and any existing | ||||||
| 10 | collective bargaining agreements. The rights of employees | ||||||
| 11 | under any existing pension, retirement, or annuity plan shall | ||||||
| 12 | not be affected by the consolidation or this amendatory Act of | ||||||
| 13 | the 99th General Assembly.

| 14 | Section 99. Effective date. This Act takes effect upon | ||||||
| 15 | becoming law.".
