AMENDMENT TO HOUSE BILL 494

AMENDMENT NO. ______. Amend House Bill 494 as follows:

by replacing line 26 on page 2 through line 5 on page 3 with the following: "determine if such applicants have been convicted of any of the enumerated criminal or drug offenses set forth in Section 21B-80 21-23a of this Code within the delineated time frames or"; and

on page 3, line 6, by replacing "2 7" with "7"; and

by replacing line 24 on page 5 through line 3 of page 6 with the following: "initiated or who has been convicted of any offense enumerated in Section 21B-80 of this Code within the delineated time frames or any"; and

on page 7, by replacing lines 14 through 17 with the following: "criminal or drug offenses in subsection (c) of this Section within the delineated time frames or have"; and

on page 7, line 18, by replacing "2 7" with "7"; and

on page 10, by replacing lines 22 through 26 with the following: "criminal or drug offenses in subsection (c) within the delineated time frames or has not been convicted, within 7 years of the application for"; and

on page 11, by replacing lines 12 through 16 with the following: "not been convicted of any of the enumerated criminal or drug offenses in subsection (c) within the delineated time frames or has not been convicted, within 7"; and

on page 12, by replacing lines 12 through 18 with the following: "been convicted of any offense that would subject him or her to license suspension or revocation pursuant to Section 21B-80 of this Code within the delineated time frames. Further, no school board shall"; and

on page 16, by replacing lines 1 and 2 with the following:

"Sec. 21B-80. Automatic disqualifying convictions for employment, licensure, and revocation of licensure Conviction of certain offenses as grounds for revocation of license."; and

on page 16, line 18, after "Act", by inserting ", Sections 6-3.3 and 5-6-3.4 of the Unified Code of Corrections, or Article 40 of the Alcoholism and Other Drug Abuse and Dependency Act"; and

on page 16, line 25, after "Act", by inserting "or Article 40 of the Alcoholism and Other Drug Abuse and Dependency Act"; and

on page 17, line 10, before "The changes", by inserting "Convictions under this definition are automatically disqualifying for a period of 5 years following the completion of the probationary sentence or release from incarceration, after which point the individual's conviction history is reviewable."; and

on page 17, by replacing line 15 with the following: "through 11-9.5, inclusive, and 11-30 (if punished as a felony), of the Criminal Code"; and

on page 19, by replacing lines 14 through 18 with the following: "convicted of any of the enumerated criminal or drug offenses in subsection (c) of this Section within the delineated time frames or have been convicted, within 7 years"; and

on page 22, by replacing lines 21 through 24 with the following: "criminal or drug offenses in subsection (c) within the delineated time frames or has not"; and

on page 23, by replacing lines 11 through 15 with the following: "not been convicted of any of the enumerated criminal or drug offenses in subsection (c) within the delineated time frame or has not been convicted, within 7"; and

on page 24, by replacing lines 11 through 17 with the following: "person who has been convicted of any offense that would subject him or her to license suspension or revocation pursuant to Section 21B-80 of this Code within the delineated time frames. Further,".
