shall be subject to the referendum.

12 | | (a) Within 30 days after the effective date of this |

1995, the terms of all members of the Chicago |
14 | | Board of Education
holding office on that date are abolished |
15 | | and the Mayor shall appoint,
without the consent or approval of |
16 | | the City Council, a 5 member
Chicago School Reform Board of |
17 | | Trustees which shall take office upon the
appointment of the |
18 | | fifth member. The Chicago School
Reform Board of Trustees and |
19 | | its members
shall serve until, and the terms of all members of |
20 | | the Chicago School
Reform Board of Trustees shall expire on, |
21 | | June 30, 1999 or upon the
appointment of a new Chicago Board of |
22 | | Education as provided
in subsection (b), whichever is later. |
23 | | Any vacancy in the membership of
the Trustees shall be filled |
24 | | through appointment by the Mayor,
without the consent or |

officer shall be determined by the Mayor. The Mayor, |

officer.

9 | | (b) This subsection (b) applies until March 20, 2018. |
10 | | Within 30 days before the expiration of the terms of the |
11 | | members of
the Chicago Reform Board of Trustees as provided in |
12 | | subsection (a), a new
Chicago Board of Education consisting of |
13 | | 7 members shall be appointed by the
Mayor to take office on the |
14 | | later of July 1, 1999 or the appointment of the
seventh member. |
15 | | Three of the members initially so appointed under this
|
16 | | subsection shall serve for terms ending June 30, 2002, 4 of the |
17 | | members
initially so appointed under this subsection shall |
18 | | serve for terms ending
June 30, 2003, and each member initially |
19 | | so appointed shall continue to hold
office until his or her |
20 | | successor is appointed and qualified. Thereafter at
the |
21 | | expiration of the term of any member a successor
shall be |
22 | | appointed by the Mayor and shall hold office for a term of 4 |
23 | | years,
from July 1 of the year in which the term commences and |
24 | | until a successor
is appointed and qualified. Any vacancy in |
25 | | the membership of the Chicago Board
of Education shall be |
26 | | filled through appointment by the Mayor for the
unexpired term. |

this subsection shall require |

Council, whether the appointment is |

for an unexpired term |
5 | | on the Board. The terms of all members of the Chicago Board of |
6 | | Education appointed under this subsection (b) shall terminate |
7 | | on March 20, 2018. |
8 | | (b-5) On March 21, 2018, a new Chicago Board of Education, |
9 | | consisting of 15 members, shall be elected by the electors of |
10 | | the school district as provided in this subsection (b-5). |
11 | | Each member shall be elected for a term of 4 years, |
12 | | commencing on the second Tuesday in May of the year in which |
13 | | the member is elected, and until the member's successor is |
14 | | elected and has qualified, except that members of the board |
15 | | elected to terms commencing on March 21, 2018 shall serve for |
16 | | terms of 5 years and until the member's successor is elected |
17 | | and has qualified. For purposes of elections conducted under |
18 | | this subsection (b-5), the City of Chicago shall be subdivided |
19 | | into 14 electoral districts by the General Assembly for seats |
20 | | on the Chicago Board of Education, as provided under Section |
21 | | 34-21.9 of this Code. Each district shall be represented by a |
22 | | member, and one member shall be elected at large and serve as |
23 | | the president of the board. |
24 | | Within 28 days after each member enters office, the board |
25 | | shall organize by electing its vice president and fixing a time |
26 | | and place for the regular meetings. No less than a majority of |
|

1 | | the board's regular meetings shall take place after regular |
2 | | business hours in order to maximize community participation. |
3 | | Upon organizing itself as provided in this subsection (b-5), |
4 | | the board shall enter upon the discharge of its duties. All |
5 | | board members must complete the training required of school |
6 | | board members under Section 10-16a of this Code. |
7 | | Whenever a vacancy in the board occurs, the remaining |
8 | | members of the board shall notify the Mayor of that vacancy |
9 | | within 5 days after its occurrence and shall proceed to fill |
10 | | the vacancy until the next board election, at which election a |
11 | | successor shall be elected to serve the remainder of the |
12 | | unexpired term. However, if the vacancy occurs with less than |
13 | | 28 months remaining in the term or if the vacancy occurs less |
14 | | than 88 days before the next board election, then the person so |
15 | | appointed shall serve the remainder of the unexpired term, and |
16 | | no election to fill the vacancy shall be held. The successor |
17 | | shall have the same residential and other qualifications as his |
18 | | or her predecessor. Should the remaining board members fail to |
19 | | act within 45 days after the vacancy occurs, the Mayor shall, |
20 | | within 30 days after the remaining members have failed to fill |
21 | | the vacancy, fill the vacancy as provided for in this Section. |
22 | | Upon the Mayor's failure to fill the vacancy, the vacancy shall |
23 | | be filled at the next board election. The successor shall have |
24 | | the same residential and other qualifications as his or her |
25 | | predecessor. |
26 | | (b-10) The board shall elect annually from its

15 | | (b-15) No member shall have, or be an employee or owner of |
16 | | a company that has, a contract with the school district. No |
17 | | former officer, member, or employee of the board shall, within |
18 | | a period of one year immediately after termination of service |
19 | | on the board, knowingly accept employment or receive |
20 | | compensation or fees for services from a person or entity if |
21 | | the officer, member, or employee, during the year immediately |
22 | | preceding termination of service on the board, participated |
23 | | personally and substantially in the award of contracts with the |
24 | | board or the school district, or the issuance of contract |
25 | | change orders with the board or the school district, with a |
26 | | cumulative value of $25,000 or more to the person or entity, or |
|

2 | | (c) The board may appoint a student to the board to serve |
3 | | in an advisory capacity. The student member shall serve for a |

6 | | student member as an advisor. The student member may not |
7 | | participate in or attend any executive session of the board.

Chicago School Reform Board of Trustees; |
11 | | powers and duties;
chief operating, fiscal, educational, and |
12 | | purchasing officers. The General
Assembly finds that an |
13 | | education crisis exists in the Chicago Public Schools
and that |
14 | | a 5-member Chicago School Reform Board of Trustees shall be
|
15 | | established for a 4 year period to bring educational and |
16 | | financial
stability to the system. The Trustees and their chief |
17 | | executive officer are
empowered and directed to:
(i) increase |
18 | | the quality of educational services in the Chicago Public |
19 | | Schools;
(ii) reduce the cost of non-educational services and |
20 | | implement cost-saving
measures including the privatization of |
21 | | services where deemed appropriate;
(iii) develop a long-term
|
22 | | financial plan that to the maximum extent possible reflects a |
23 | | balanced budget
for each year; (iv) streamline and strengthen |
24 | | the management of the system,
including a responsible |
25 | | school-based budgeting process, in order to refocus
resources |

1 | | on student achievement; (v) ensure ongoing academic |
2 | | improvement in
schools through the establishment of an Academic |
3 | | Accountability Council and a

5 | | ensure the system runs in an ethical as well as efficient
|
6 | | manner; (vii) establish within 60 days after the effective date |
7 | | of this
amendatory Act of 1995, develop, and implement a |
8 | | process for the selection of a
local school council advisory |
9 | | board for the Trustees in which those individuals
active on |
10 | | Local School Councils serve an advisory role to the Trustees; |
11 | | (viii)
establish any organizational structures, including |
12 | | regional offices, that it
deems necessary to ensure the |
13 | | efficient and effective operation of the system;
and (ix) |
14 | | provide for such other local school council advisory bodies as |
15 | | the
Trustees deem appropriate to function in an advisory |
16 | | capacity to any other
organizations or offices established by |
17 | | the Trustees under clause (viii) of
this Section.

18 | | (a) Unless otherwise provided in this Article, the Trustees |
19 | | shall have all
powers and duties exercised and performed by the |
20 | | Chicago Board
of Education at the time the terms of its members |
21 | | are abolished as provided in
subsection (a) of Section 34-3.
|
22 | | (b) The Mayor shall appoint a chief executive officer who |
23 | | shall be a person
of recognized administrative ability
and |
24 | | management experience, who shall be responsible for the |
25 | | management of
the system, and who shall have all
other powers |
26 | | and duties of the general superintendent as set forth in this
|

1 | | Article 34. The chief executive officer shall make |
2 | | recommendations to the
Trustees with respect to contracts, |
3 | | policies, and procedures.

4 | | (c) The chief executive officer shall appoint, with the |

Trustees, a chief operating officer, a chief |
6 | | fiscal officer, a chief
educational officer, and a chief |
7 | | purchasing officer to serve until June
30, 1999. These officers |
8 | | shall be assigned duties and responsibilities
by the chief |
9 | | executive officer. The chief operating officer, the chief |
10 | | fiscal
officer, the chief educational officer, and the chief |
11 | | purchasing officer may be
granted authority to hire a specific |
12 | | number of employees to assist in meeting
immediate |
13 | | responsibilities. The chief executive officer may remove any
|
14 | | officer, subject to the approval of the Trustees. Conditions of |
15 | | employment for
such personnel shall not be subject to the |
16 | | provisions of Section 34-85.
|
17 | | (d) Upon the expiration on June 30, 1999 of the terms of |
18 | | office of the
chief executive, operating, fiscal, educational, |
19 | | and purchasing officers
appointed under this Section and the |
20 | | appointment of a new Chicago Board of
Education under |
21 | | subsection (b) of Section 34-3, the board may retain,
|
22 | | reorganize, or abolish any or all of those offices and appoint |
23 | | qualified
successors to fill any of those offices that it does |
24 | | not abolish. However, chief executive officer appointed under |
25 | | this subsection (d) shall serve until the Chicago Board of |
26 | | Education elected pursuant to subsection (b-5) of Section 34-3 |

and such other matters as the Trustees deem necessary |

continuing improvement in the public school |

reports shall be public documents |
12 | | and shall be made annually, beginning with
the school year that |
13 | | commences in 1995 and concluding in the school year
beginning |
14 | | in 1999.

4 | | ballot order of candidates for full terms in the event of any |
5 | | simultaneous petition filings. Such candidate lottery shall be |
6 | | conducted as follows: |
7 | | All petitions filed by persons waiting in line as of 8:00 |
8 | | a.m. on the first day for filing, or as of the normal opening |
9 | | hour of the office involved on such day, shall be deemed |
10 | | simultaneously filed as of 8:00 a.m. or the normal opening |
11 | | hour, as the case may be. Petitions filed by mail and received |
12 | | after midnight of the first day for filing and in the first |
13 | | mail delivery or pickup of that day shall be deemed |
14 | | simultaneously filed as of 8:00 a.m. of that day or as of the |
15 | | normal opening hour of such day, as the case may be. All |
16 | | petitions received thereafter shall be deemed filed in the |
17 | | order of actual receipt. However, 2 or more petitions filed |
18 | | within the last hour of the filing deadline shall be deemed |
19 | | filed simultaneously. |
20 | | Where 2 or more petitions are received simultaneously for |
21 | | the same office as of 8:00 a.m. on the first day for petition |
22 | | filing or as of the normal opening hour of the office of the |
23 | | board of election commissioners with whom such petitions are |
24 | | filed, the board of election commissioners shall break ties and |
25 | | determine the order of filing by means of a lottery or other |
26 | | fair and impartial method of random selection. Such lottery |

6 | | to each organization of citizens within the election |
7 | | jurisdiction that was entitled, under the general election law, |
8 | | at the next preceding election, to have poll watchers present |

10 | | shall post in a conspicuous, open, and public place, at the |
11 | | entrance of his or her office, notice of the time and place of |
12 | | such lottery. |
13 | | All candidates shall be certified in the order in which |
14 | | their petitions have been filed and in the manner prescribed by |
15 | | Section 10-15 of the Election Code. Where candidates have filed |
16 | | simultaneously, they shall be certified in the order prescribed |
17 | | by this Section and prior to candidates who filed for the same |

19 | | Where elections are conducted for unexpired terms, a second |

|
11 | | (a) The Inspector General and his office in existence on |

to conduct investigations into |

of 1996 shall serve for a |
24 | | term expiring on June 30, 1998. His or her
successors in office |
25 | | shall each be appointed by the Mayor, without the consent

2 | | 30th of an
even numbered year ; however, beginning on March 21, |

If the Inspector General leaves office or if a vacancy |
5 | | in that office otherwise occurs, the
Mayor shall appoint, |
6 | | without the consent or
approval of the City Council, a |
7 | | successor to serve under this Section for the
remainder of the |
8 | | unexpired term ; however, beginning on March 21, 2018, |
9 | | successors shall be appointed by the board instead of the |
10 | | Mayor . The
Inspector General shall be independent of the |
11 | | operations of the board and
the School Finance Authority, and |
12 | | shall perform other duties requested by the
board.
|
13 | | (b) The Inspector General shall have access to all
|
14 | | information and personnel necessary to perform the duties of |
15 | | the
office. If the Inspector General determines that a possible
|
16 | | criminal act has been committed or that special expertise is
|
17 | | required in the investigation, he or she shall immediately |
18 | | notify
the Chicago Police Department and the Cook County |
19 | | State's
Attorney. All investigations conducted by the |
20 | | Inspector General
shall be conducted in a manner that ensures |
21 | | the preservation of
evidence for use in criminal prosecutions.

22 | | (c) At all times the Inspector General shall be granted
|
23 | | access to any building or facility that is owned, operated, or
|
24 | | leased by the board, the Public Building Commission, or the
|
25 | | city in trust
and for the use and benefit of the schools of the |
26 | | district.

1 | | (d) The Inspector General shall have the power to subpoena
|
2 | | witnesses and compel the production of books and papers |
3 | | pertinent
to an investigation authorized by this Code. Any |
4 | | person who (1)
fails to appear in response to a subpoena; (2) |
5 | | fails to answer
any question; (3) fails to produce any books or |
6 | | papers pertinent
to an investigation under this Code; or (4) |
7 | | knowingly gives
false testimony during an investigation under |
8 | | this Code, is
guilty of a Class A misdemeanor.

9 | | (e) The Inspector General shall provide to the board and
|
10 | | the Illinois General Assembly a summary of reports and
|
11 | | investigations made under this Section for the previous fiscal
|
12 | | year no later than January 1 of each year, except that the |
13 | | Inspector General
shall provide the summary of reports and |
14 | | investigations made under this Section
for the period |
15 | | commencing July 1, 1998 and ending April 30, 1999 no later than
|
16 | | May 1, 1999. The summaries shall detail the final disposition |
17 | | of those
recommendations. The summaries shall not contain any |
18 | | confidential or
identifying information concerning the |
19 | | subjects of the reports and
investigations. The summaries shall |
20 | | also include detailed recommended
administrative actions and |
21 | | matters for consideration by the General Assembly.

3 | | (a) For purposes of elections conducted pursuant to |
4 | | subsection (b-5) of Section 34-3, the City of Chicago shall be |
5 | | subdivided into 14 electoral districts after the effective date |
6 | | of this amendatory Act of the 99th General Assembly by the |
7 | | General Assembly for seats on the Chicago Board of Education. |
8 | | The electoral districts must be drawn on or before March 1, |
9 | | 2017. Each district must be compact, contiguous, and |
10 | | substantially equal in population. |
11 | | (b) In the year following each decennial census, the |
12 | | Chicago Board of Education shall redistrict the electoral |
13 | | districts to reflect the results of the decennial census |
14 | | consistent with the requirements in subsection (a) of this |
15 | | Section. The reapportionment plan shall be completed and |
16 | | formally approved by the Chicago Board of Education not less |
17 | | than 90 days before the last date established by law for the |
18 | | filing of nominating petitions for the second school board |
19 | | election after the decennial census year. If by reapportionment |
20 | | a board member no longer resides within the electoral district |
21 | | from which the member was elected, the member shall continue to |
22 | | serve in office until the expiration of the member's regular |
23 | | term. All new members shall be elected from the electoral |
24 | | districts as reapportioned. |
25 | | (c) Creation of districts and reapportionment under this |
