AMENDMENT TO HOUSE BILL 819

2    AMENDMENT NO. ______. Amend House Bill 819 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Board of Higher Education Act is amended by
5changing Section 7 as follows:
 
6    (110 ILCS 205/7)  (from Ch. 144, par. 187)
7    Sec. 7. The Board of Trustees of the University of
8Illinois, the Board of Trustees of Southern Illinois
9University, the Board of Trustees of Chicago State University,
10the Board of Trustees of Eastern Illinois University, the Board
11of Trustees of Governors State University, the Board of
12Trustees of Illinois State University, the Board of Trustees of
13Northeastern Illinois University, the Board of Trustees of
14Northern Illinois University, the Board of Trustees of Western
15Illinois University, the Illinois Community College Board and
16the campuses under their governance or supervision shall not

1hereafter undertake the establishment of any new unit of
2instruction, research or public service without the approval of
3the Board. The term "new unit of instruction, research or
4public service" includes the establishment of a college,
5school, division, institute, department or other unit in any
6field of instruction, research or public service not
7theretofore included in the program of the institution, and
8includes the establishment of any new branch or campus. The
9term does not include reasonable and moderate extensions of
10existing curricula, research, or public service programs which
11have a direct relationship to existing programs; and the Board
12may, under its rule making power, define the character of such
13reasonable and moderate extensions.
14    Such governing boards shall submit to the Board all
15proposals for a new unit of instruction, research, or public
16service. The Board may approve or disapprove the proposal in
17whole or in part or approve modifications thereof whenever in
18its judgment such action is consistent with the objectives of
19an existing or proposed master plan of higher education.
20    The Board shall permit a community college district to
21offer, beginning with the 2016-2017 academic year, at least one
22program of study in an academic or technical field that leads
23to a bachelor of arts or science degree awarded by the
24community college.
25    The Board of Higher Education is authorized to review
26periodically all existing programs of instruction, research

1and public service at the State universities and colleges and
2to advise the appropriate board of control if the contribution
3of each program is not educationally and economically
4justified. Each State university shall report annually to the
5Board on programs of instruction, research, or public service
6that have been terminated, dissolved, reduced, or consolidated
7by the university. Each State university shall also report to
8the Board all programs of instruction, research, and public
9service that exhibit a trend of low performance in enrollments,
10degree completions, and high expense per degree. The Board
11shall compile an annual report that shall contain information
12on new programs created, existing programs that have been
13closed or consolidated, and programs that exhibit low
14performance or productivity. The report must be submitted to
15the General Assembly. The Board shall have the authority to
16define relevant terms and timelines by rule with respect to
17this reporting.

19    Section 10. The Public Community College Act is amended by
20changing Section 2-12 and by adding Section 3-65 as follows:

22    Sec. 2-12. The State Board shall have the power and it
23shall be its duty:
24    (a) To provide statewide planning for community colleges as

1institutions of higher education and co-ordinate the programs,
2services and activities of all community colleges in the State
3so as to encourage and establish a system of locally initiated
4and administered comprehensive community colleges.
5    (b) To organize and conduct feasibility surveys for new
6community colleges or for the inclusion of existing
7institutions as community colleges and the locating of new
8institutions.
9    (c) To approve all locally funded capital projects for
10which no State monies are required, in accordance with
11standards established by rule.
12    (d) To cooperate with the community colleges in continuing
13studies of student characteristics, admission standards,
14grading policies, performance of transfer students,
15qualification and certification of facilities and any other
16problem of community college education.
17    (e) To enter into contracts with other governmental
18agencies and eligible providers, such as local educational
19agencies, community-based organizations of demonstrated
20effectiveness, volunteer literacy organizations of
21demonstrated effectiveness, institutions of higher education,
22public and private nonprofit agencies, libraries, and public
23housing authorities; to accept federal funds and to plan with
24other State agencies when appropriate for the allocation of
25such federal funds for instructional programs and student
26services including such funds for adult education and adult

1literacy, vocational and technical education, and retraining
2as may be allocated by state and federal agencies for the aid
3of community colleges. To receive, receipt for, hold in trust,
4expend and administer, for all purposes of this Act, funds and
5other aid made available by the federal government or by other
6agencies public or private, subject to appropriation by the
7General Assembly. The changes to this subdivision (e) made by
8this amendatory Act of the 91st General Assembly apply on and
9after July 1, 2001.
10    (f) To determine efficient and adequate standards for
11community colleges for the physical plant, heating, lighting,
12ventilation, sanitation, safety, equipment and supplies,
13instruction and teaching, curriculum, library, operation,
14maintenance, administration and supervision, and to grant
15recognition certificates to community colleges meeting such
16standards.
17    (g) To determine the standards for establishment of
18community colleges and the proper location of the site in
19relation to existing institutions of higher education offering
20academic, occupational and technical training curricula,
21possible enrollment, assessed valuation, industrial, business,
22agricultural, and other conditions reflecting educational
23needs in the area to be served; however, no community college
24may be considered as being recognized nor may the establishment
25of any community college be authorized in any district which
26shall be deemed inadequate for the maintenance, in accordance

1with the desirable standards thus determined, of a community
2college offering the basic subjects of general education and
3suitable vocational and semiprofessional and technical
4curricula.
5    (h) To approve or disapprove new units of instruction,
6research or public service as defined in Section 3-25.1 of this
7Act submitted by the boards of trustees of the respective
8community college districts of this State. The State Board
9shall permit a community college district to offer, beginning
10with the 2016-2017 academic year, at least one program of study
11in an academic or technical field that leads to a bachelor of
12arts or science degree awarded by the community college. The
13State Board may discontinue programs which fail to reflect the
14educational needs of the area being served. The community
15college district shall be granted 60 days following the State
16Board staff recommendation and prior to the State Board's
17action to respond to concerns regarding the program in
18question. If the State Board acts to abolish a community
19college program, the community college district has a right to
20appeal the decision in accordance with administrative rules
21promulgated by the State Board under the provisions of the
22Illinois Administrative Procedure Act.
23    (i) To participate in, to recommend approval or
24disapproval, and to assist in the coordination of the programs
25of community colleges participating in programs of
26interinstitutional cooperation with other public or nonpublic

1institutions of higher education. If the State Board does not
2approve a particular cooperative agreement, the community
3college district has a right to appeal the decision in
4accordance with administrative rules promulgated by the State
5Board under the provisions of the Illinois Administrative
6Procedure Act.
7    (j) To establish guidelines regarding sabbatical leaves.
8    (k) To establish guidelines for the admission into special,
9appropriate programs conducted or created by community
10colleges for elementary and secondary school dropouts who have
11received truant status from the school districts of this State
12in compliance with Section 26-14 of The School Code.
13    (l) The Community College Board shall conduct a study of
14community college teacher education courses to determine how
15the community college system can increase its participation in
16the preparation of elementary and secondary teachers.
17    (m) To establish by July 1, 1997 uniform financial
18accounting and reporting standards and principles for
19community colleges and develop procedures and systems for
20community colleges for reporting financial data to the State
21Board.
22    (n) To create and participate in the conduct and operation
23of any corporation, joint venture, partnership, association,
24or other organizational entity that has the power: (i) to
25acquire land, buildings, and other capital equipment for the
26use and benefit of the community colleges or their students;

1(ii) to accept gifts and make grants for the use and benefit of
2the community colleges or their students; (iii) to aid in the
3instruction and education of students of community colleges;
4and (iv) to promote activities to acquaint members of the
5community with the facilities of the various community
6colleges.
7    (o) On and after July 1, 2001, to ensure the effective
8teaching of adults and to prepare them for success in
9employment and lifelong learning by administering a network of
10providers, programs, and services to provide adult basic
11education, adult secondary and high school equivalency testing
12education, English as a second language, and any other
13instruction designed to prepare adult students to function
14successfully in society and to experience success in
15postsecondary education and the world of work.
16    (p) On and after July 1, 2001, to supervise the
17administration of adult education and adult literacy programs,
18to establish the standards for such courses of instruction and
19supervise the administration thereof, to contract with other
20State and local agencies and eligible providers, such as local
21educational agencies, community-based organizations of
22demonstrated effectiveness, volunteer literacy organizations
23of demonstrated effectiveness, institutions of higher
24education, public and private nonprofit agencies, libraries,
25and public housing authorities, for the purpose of promoting
26and establishing classes for instruction under these programs,

1to contract with other State and local agencies to accept and
2expend appropriations for educational purposes to reimburse
3local eligible providers for the cost of these programs, and to
4establish an advisory council consisting of all categories of
5eligible providers; agency partners, such as the State Board of
6Education, the Department of Human Services, the Department of
7Employment Security, and the Secretary of State literacy
8program; and other stakeholders to identify, deliberate, and
9make recommendations to the State Board on adult education
10policy and priorities. The State Board shall support statewide
11geographic distribution; diversity of eligible providers; and
12the adequacy, stability, and predictability of funding so as
13not to disrupt or diminish, but rather to enhance, adult
14education by this change of administration.

17    Sec. 3-65. Bachelor's degrees. Notwithstanding any other
18law to the contrary, beginning with the 2016-2017 academic
19year, each community college district shall offer at least one
20program of study in an academic or technical field that leads
21to a bachelor of arts or science degree awarded by the
22community college, subject to Section 2-12 of this Act and
23Section 7 of the Board of Higher Education Act.".
