AMENDMENT TO HOUSE BILL 971

2    AMENDMENT NO. ______. Amend House Bill 971 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Public Aid Code is amended by
5changing Section 8A-18 as follows:
 
6    (305 ILCS 5/8A-18)
7    Sec. 8A-18. Application assistance fraud; SNAP; AABD;
8TANF. It is a Class C misdemeanor for any person, including an
9individual, firm, corporation, association, partnership, or
10joint venture, or any employee or agent of any of those, to
11assist or represent another person in completing or submitting
12an application for benefits under the federal Supplemental
13Nutrition Assistance Program (SNAP), the State's Aid to the
14Aged, Blind, or Disabled (AABD) program, or the State's
15Temporary Assistance for Needy Families (TANF) program, in
16exchange for a portion of the applicant's SNAP, AABD, or TANF

1benefits or cash or any other form of payment from any other
2source. An applicant who receives such assistance or
3representation is not in violation of this Section.
4    Nothing in this Section shall be construed as prohibiting
5an applicant from using the services of a non-profit
6organization, a licensed attorney, or any other authorized
7organization or agency that receives State or federal funding
8to assist persons in the preparation of an application for
9SNAP, AABD, or TANF benefits or in appealing a denial of an
10application for SNAP, AABD, or TANF benefits. Nothing in this
11Section shall be construed as prohibiting an applicant from
12receiving such assistance or representation when appealing a
13denial of an application for SNAP, AABD, or TANF benefits.
