| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Employee Benefit Contribution Act is amended |
| 5 | | by changing Section 2 as follows:
|
| 6 | | (820 ILCS 160/2) (from Ch. 48, par. 39x)

| 7 | | Sec. 2.
Any employer who has agreed to make payments to an |
| 8 | | employee
health insurance plan shall notify its employees of |
| 9 | | any failure to make
such payments where such failure shall |
| 10 | | result in the
the total
loss of insurance coverage
so as to |
| 11 | | provide its employees a reasonable opportunity to replace such
|
| 12 | | coverage at the time the employee health insurance plan |
| 13 | | terminates.
The employer must provide written notification |
| 14 | | directly to each of its
employees who
are covered under the |
| 15 | | plan. Any employer who fails to provide timely notice of a
|
| 16 | | prospective
termination of a health insurance plan, which |
| 17 | | failure results in the
deprivation
of the opportunity to |
| 18 | | replace such coverage and which further results in
damages to |
| 19 | | one or more employees arising from the loss of coverage,
shall |
| 20 | | be guilty of a Class B misdemeanor. |
