| 5 | | adding Section 22.40a as follows:

| 7 | | Sec. 22.40a. Disposal of manufactured gas plant waste in |
| 8 | | waste disposal sites other than permitted hazardous waste |
| 9 | | disposal sites prohibited. Notwithstanding any other law or |
| 10 | | regulation, no person shall dispose, in a waste disposal site |
| 11 | | other than a permitted hazardous waste disposal site, waste |
| 12 | | generated from the remediation of a manufactured gas plant site |
| 13 | | or facility, unless (i) the waste is tested using Method 1311 |
| 14 | | (Toxicity Characteristic Leaching Procedure (TCLP)) in "Test |
| 15 | | Methods for Evaluating Solid Waste, Physical/Chemical |
| 16 | | Methods," USEPA Publication Number EPA 530/SW-846, and (ii) |
