Amends the Illinois Public Aid Code. Prohibits the State from accepting any special terms and conditions for federal approval of any Medicaid research and demonstration project waiver proposal submitted to the U.S. Department of Health and Human Services on June 4, 2014. Requires the State to immediately withdraw all pending Section 1115 research and demonstration project waiver proposals submitted on or after June 4, 2014. Provides that the State shall not submit to the U.S. Department of Health and Human Services any Section 1115 demonstration project waiver proposal without first receiving specific statutory authority detailing the parameters of the proposal prior to its submission for federal approval. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 12-4.49 as follows: |
6 | | (305 ILCS 5/12-4.49 new) |
7 | | Sec. 12-4.49. Research and demonstration project waiver
|
8 | | proposal; prohibition; parameters. |
9 | | (a) The State shall not accept any special terms and |
10 | | conditions for federal approval of any research and |
11 | | demonstration project waiver proposal submitted to the U.S. |
12 | | Department of Health and Human Services on June 4, 2014 under |
13 | | Section 1115 of the Social Security Act. The State shall |
14 | | immediately withdraw all pending Section 1115 research and |
15 | | demonstration project waiver proposals submitted on or after |
16 | | June 4, 2014. |
17 | | (b) The State shall not submit to the U.S. Department of |
18 | | Health and Human Services any Section 1115 research and |
19 | | demonstration project waiver proposal without first receiving |
20 | | specific statutory authority detailing the parameters of the |
21 | | proposal prior to its submission for federal approval.
