| 1 | | AN ACT concerning regulation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Department of Professional Regulation Law of |
| 5 | | the
Civil Administrative Code of Illinois is amended by adding |
| 6 | | Section 2105-170 as follows: |
| 7 | | (20 ILCS 2105/2105-170 new) |
| 8 | | Sec. 2105-170. Health care workers; automatic suspension |
| 9 | | of license. A health care worker, as defined by the Health Care |
| 10 | | Worker Self-Referral Act, licensed by the Department shall be |
| 11 | | automatically and indefinitely suspended at such time as the |
| 12 | | final trial proceedings are concluded whereby a licensee has |
| 13 | | been either convicted of, or has entered a plea of guilty or |
| 14 | | nolo contendere in a criminal prosecution to, a criminal health |
| 15 | | care or criminal insurance fraud offense, requiring intent, |
| 16 | | under the laws of the State, the laws of any other state, or |
| 17 | | the laws of the United States of America, including, but not |
| 18 | | limited to, criminal Medicare or Medicaid fraud. A certified |
| 19 | | copy of the conviction or judgment shall be the basis for the |
| 20 | | suspension. If a licensee requests a hearing, then the sole |
| 21 | | purpose of the hearing shall be limited to the length of the |
| 22 | | suspension of the licensee's license, as the conviction or |
| 23 | | judgment is a matter of record and may not be challenged.
