AMENDMENT TO HOUSE BILL 1359




2    AMENDMENT NO. ______. Amend House Bill 1359, AS AMENDED, by 
3replacing everything after the enacting clause with the 
4following:

 
5    "Section 5. The Department of Professional Regulation Law 
6of the
Civil Administrative Code of Illinois is amended  by 
7adding Section 2105-170 as follows:
 
8    (20 ILCS 2105/2105-170 new)
9    Sec. 2105-170. Health care workers; automatic suspension 
10of license. A health care worker, as defined by the Health Care 
11Worker Self-Referral Act, licensed by the Department shall be 
12automatically and indefinitely suspended at such time as the 
13final trial proceedings are concluded whereby a licensee has 
14been either convicted of, or has entered a plea of guilty or 
15nolo contendere in a criminal prosecution to, a criminal health 
16care or criminal insurance fraud offense, requiring intent,

1under the laws of the State, the laws of any other state, or 
2the laws of the United States of America, including, but not 
3limited to, criminal Medicare or Medicaid fraud.  A certified 
4copy of the conviction or judgment shall be the basis for the 
5suspension.  If a licensee requests a hearing, then the sole 
6purpose of the hearing shall be limited to the length of the 
7suspension of the licensee's license, as the conviction or 
8judgment is a matter of record and may not be challenged.".
