Amends the Public Officer Prohibited Activities Act. Provides that an elected official may not hold more than one public office simultaneously. Specifies that the limitation applies regardless of whether the elected official receives compensation for a public office. Defines "elected official" and "public office". Effective immediately.

1 | | AN ACT concerning local government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Public Officer Prohibited Activities Act is |
5 | | amended by adding Section 4.10 as follows: |
6 | | (50 ILCS 105/4.10 new) |
7 | | Sec. 4.10. Limitation; more than one public office. |
8 | | (a) An elected official may not hold more than one public |
9 | | office simultaneously. This limitation applies regardless of |
10 | | whether the elected official receives compensation for a public |
11 | | office. |
12 | | (b) As used in this Section: |
13 | | "Elected official" means any person who holds an office |
14 | | that is subject to election in accordance with the Election |
15 | | Code. |
16 | | "Public office" means an office to which a person is |
17 | | elected or appointed to discharge a public duty for the State |
18 | | or any of its political subdivisions and an office which is |
19 | | established and the qualifications and duties are prescribed by |
20 | | statute.

21 | | Section 99. Effective date. This Act takes effect upon |
22 | | becoming law.
