SYNOPSIS AS INTRODUCED:
 
625 ILCS 5/11-1414.1  from Ch. 95 1/2, par. 11-1414.1

    Amends the Illinois Vehicle Code. Provides that a student in grades K through 12 with an Individualized Education Plan (IEP) with a staff to student ratio of 1 to 5 may be transported in a multi-function school activity bus for any curriculum-related activity except for transportation on regular bus routes from home to school or from school to home.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1414.1 as follows:
 
6    (625 ILCS 5/11-1414.1)  (from Ch. 95 1/2, par. 11-1414.1)
7    Sec. 11-1414.1. School transportation of students.
8    (a) Every student enrolled in grade 12 or below in any
9entity listed in subsection (a) of Section 1-182 of this Code
10must be transported in a school bus or a vehicle described in
11subdivision (1) or (2) of subsection (b) of Section 1-182 of
12this Code for any curriculum-related school activity, except a
13student in any of grades 9 through 12 or a student in any of
14grades K though 12 with an Individualized Education Plan (IEP)
15with a staff to student ratio of 1 to 5, may be transported in a
16multi-function school activity bus (MFSAB) as defined in
17Section 1-148.3a-5 of this Code for any curriculum-related
18activity except for transportation on regular bus routes from
19home to school or from school to home, subject to the following
20conditions:
21        (i) A MFSAB may not be used to transport students under
22    this Section unless the driver holds a valid school bus
23    driver permit.

1        (ii) The use of a MFSAB under this Section is subject
2    to the requirements of Sections 6-106.11, 6-106.12,
3    12-707.01, 13-101, and 13-109 of this Code.
4    "Curriculum-related school activity" as used in this
5subsection (a) includes transportation from home to school or
6from school to home, tripper or shuttle service between school
7attendance centers, transportation to a vocational or career
8center or other trade-skill development site or a regional safe
9school or other school-sponsored alternative learning program,
10or a trip that is directly related to the regular curriculum of
11a student for which he or she earns credit.
12    (b) Every student enrolled in grade 12 or below in any
13entity listed in subsection (a) of Section 1-182 of this Code
14who is transported in a vehicle that is being operated by or
15for a public or private primary or secondary school, including
16any primary or secondary school operated by a religious
17institution, for an interscholastic, interscholastic-athletic,
18or school-sponsored, noncurriculum-related activity that (i)
19does not require student participation as part of the
20educational services of the entity and (ii) is not associated
21with the students' regular class-for-credit schedule shall
22transport students only in a school bus or vehicle described in
23subsection (b) of Section 1-182 of this Code. This subsection
24(b) does not apply to any second division vehicle used by an
25entity listed in subsection (a) of Section 1-182 of this Code
26for a parade, homecoming, or a similar noncurriculum-related
