Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a manufacturer or distributor of prescription contact lenses to prevent a retailer from selling or advertising contact lenses below any specified price.

1 | | AN ACT concerning business.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Consumer Fraud and Deceptive Business |
5 | | Practices Act is amended by adding Section 2TTT as follows: |
6 | | (815 ILCS 505/2TTT new) |
7 | | Sec. 2TTT. Contact lenses; unilateral pricing policies |
8 | | prohibited. It is an unlawful practice under this Act for a |
9 | | manufacturer or distributor of prescription contact lenses to: |
10 | | (1) prevent, by any means, including through a |
11 | | unilateral policy or agreement, any retailer from selling |
12 | | or advertising contact lenses to consumers below any |
13 | | specified price or to otherwise limit the ability of any |
14 | | retailer to determine prices at which contact lenses are |
15 | | offered or advertised to consumers; or |
16 | | (2) restrict options available to contact lens |
17 | | consumers by discriminating in the distribution of contact |
18 | | lenses based upon the channel of trade or based upon |
19 | | whether the retailer is, or is associated with, a person or |
20 | | entity, authorized by law to prescribe contact lenses.
