1 | | AN ACT concerning public aid.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | changing Section 8A-18 as follows: |
6 | | (305 ILCS 5/8A-18) |
7 | | Sec. 8A-18. Application assistance fraud; SNAP; AABD; |
8 | | TANF. It is a Class C misdemeanor for any person, including an |
9 | | individual, firm, corporation, association, partnership, or |
10 | | joint venture, or any employee or agent of any of those, to |
11 | | assist or represent another person in completing or submitting |
12 | | an application for benefits under the federal Supplemental |
13 | | Nutrition Assistance Program (SNAP), the State's Aid to the |
14 | | Aged, Blind, or Disabled (AABD) program, or the State's |
15 | | Temporary Assistance for Needy Families (TANF) program, in |
16 | | exchange for a portion of the applicant's SNAP, AABD, or TANF |
17 | | benefits or cash or any other form of payment from any other |
18 | | source. An applicant who receives such assistance or |
19 | | representation is not in violation of this Section. Nothing in |
20 | | this Section shall be construed as prohibiting an applicant |
21 | | from using the services of a non-profit organization, a |
22 | | licensed attorney, or any other authorized organization or |
23 | | agency that receives State or federal funding to assist persons |
