AMENDMENT TO HOUSE BILL 2483




2    AMENDMENT NO. ______. Amend House Bill 2483 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Public Aid Code is amended  by 
5changing Section 8A-18 as follows:
 
6    (305 ILCS 5/8A-18)
7    Sec. 8A-18. Application assistance fraud; SNAP; AABD; 
8TANF. It is a Class C misdemeanor for any person, including an 
9individual, firm, corporation, association, partnership, or 
10joint venture, or any employee or agent of any of those, to 
11impose, accept, or receive payment or compensation in any form 
12from public aid applicants or recipients for assistance with 
13assist or represent another person in completing or submitting 
14an application or renewal application for benefits under the 
15federal Supplemental Nutrition Assistance Program (SNAP), the 
16State's Aid to the Aged, Blind, or Disabled (AABD) program, or

1the State's Temporary Assistance for Needy Families (TANF) 
2program,  in exchange for a portion of the applicant's SNAP, 
3AABD, or TANF benefits or cash or any other form of payment 
4from any other source. An applicant or recipient who receives 
5such assistance or representation is not in violation of this 
6Section. Nothing in this Section shall be construed as 
7prohibiting a person or other entity from receiving payment or 
8funding from a State or federal agency or other grant funding 
9to provide assistance to applicants for or recipients of SNAP, 
10AABD, or TANF. Nothing in this Section shall be construed as 
11prohibiting an applicant or recipient from receiving such 
12assistance or representation when appealing a SNAP, AABD, or 
13TANF matter before the Department of Human Services a denial of 
14an application for SNAP, AABD, or TANF benefits.
