Amends the Chicago Teacher Article of the Illinois Pension Code. Provides that any earned sick pay which is payable by an employer shall be considered pensionable earnings as provided by Section 17-134 and the charter school shall certify the number of sick days being paid. Also provides that any sum paid by a charter school employer before or after the school year shall be considered pensionable earnings if the payment is conditioned in any way on service being performed by the contributor. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Pension Code is amended by adding |
5 | | Section 17-133.5 as follows: |
6 | | (40 ILCS 5/17-133.5 new) |
7 | | Sec. 17-133.5. Pensionable earnings; charter school |
8 | | reporting. Any earned sick pay which is payable by an employer |
9 | | shall be considered pensionable earnings as provided by Section |
10 | | 17-134 and the charter school shall certify the number of sick |
11 | | days being paid. Any sum paid by a charter school employer |
12 | | before or after the school year shall be considered pensionable |
13 | | earnings if the payment is conditioned in any way on service |
14 | | being performed by the contributor. |
15 | | Section 90. The State Mandates Act is amended by adding |
16 | | Section 8.39 as follows: |
17 | | (30 ILCS 805/8.39 new) |
18 | | Sec. 8.39. Exempt mandate. Notwithstanding Sections 6 and 8 |
19 | | of this Act, no reimbursement by the State is required for the |
20 | | implementation of any mandate created by this amendatory Act of |
21 | | the 99th General Assembly.
