AMENDMENT TO HOUSE BILL 2510

2    AMENDMENT NO. ______. Amend House Bill 2510 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the
5For-Profit Community Corrections Prohibition Act.
 
6    Section 5. Purpose. The purpose of this Act is to provide
7effective community-based supervision and rehabilitative
8services to persons under the supervision of the Parole
9Division of the Department of Corrections or the Aftercare
10Division of the Department of Juvenile Justice.
 
11    Section 10. Definitions. As used in this Act:
12    "Community correctional supervision" includes surveillance
13of parolees and persons released on mandatory supervised
14release in the community and rehabilitative re-entry services
15for persons under the supervision of the Parole Division of the

1Department of Corrections or the Aftercare Division of the
2Department of Juvenile Justice, including residential,
3employment, educational, substance and alcohol abuse, and
4mental health programming.
5    "For-profit prison company" means a for-profit corporation
6or business entity not organized or operating as a
7not-for-profit entity that owns, manages, or operates
8correctional facilities or community correctional supervision
9services.
 
10    Section 15. Certain contracts prohibited. On or after the
11effective date of this Act, the State shall not contract with a
12for-profit prison company for community correctional
13supervision of persons in the custody of the Department of
14Corrections or the Department of Juvenile Justice. Nothing in
15this Act shall be construed to allow privatization prohibited
16by the Private Correctional Facility Moratorium Act. Nothing in
17this Act shall be construed to prohibit the renewal of a
18contract with a for-profit prison company for community
19correctional supervision of persons in the custody of the
20Department of Corrections or the Department of Juvenile Justice
21that was in effect immediately preceding the effective date of
22this Act.".
