1 | AN ACT concerning human trafficking.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the Human | |||||||||||||||||||
5 | Trafficking Resource Center Notice Act. | |||||||||||||||||||
6 | Section 5. Posted notice required. Each of the following | |||||||||||||||||||
7 | businesses and other establishments shall, upon the | |||||||||||||||||||
8 | availability of the model notice described in Section 15 of | |||||||||||||||||||
9 | this Act, post a notice that complies with the requirements of | |||||||||||||||||||
10 | this Act in a conspicuous place near the public entrance of the | |||||||||||||||||||
11 | establishment or in another conspicuous location in clear view | |||||||||||||||||||
12 | of the public and employees where similar notices are | |||||||||||||||||||
13 | customarily posted: | |||||||||||||||||||
14 | (1) On premise consumption retailer licensees under | |||||||||||||||||||
15 | the Liquor Control Act of 1934 where the sale of alcoholic | |||||||||||||||||||
16 | liquor is the principal
business carried on by the licensee | |||||||||||||||||||
17 | at the premises and primary to the
sale of food. | |||||||||||||||||||
18 | (2) Adult entertainment facilities, as defined in | |||||||||||||||||||
19 | Section 5-1097.5 of the of the Counties Code. | |||||||||||||||||||
20 | (3) Primary airports, as defined in Section 47102(16) | |||||||||||||||||||
21 | of Title 49 of the United States Code. | |||||||||||||||||||
22 | (4) Intercity passenger rail or light rail stations. | |||||||||||||||||||
23 | (5) Bus stations. |

1 | (6) Truck stops. For purposes of this Act, "truck stop" | ||||||
2 | means a privately-owned and operated facility that | ||||||
3 | provides food, fuel, shower or other sanitary facilities, | ||||||
4 | and lawful overnight truck parking. | ||||||
5 | (7) Emergency rooms within general acute care | ||||||
6 | hospitals. | ||||||
7 | (8) Urgent care centers. | ||||||
8 | (9) Farm labor contractors. | ||||||
9 | (10) Privately-operated job recruitment centers. | ||||||
10 | (11) Roadside rest areas. | ||||||
11 | (12) Businesses or establishments that offer massage | ||||||
12 | or bodywork services for compensation. | ||||||
13 | Section 10. Form of posted notice. | ||||||
14 | (a) The notice required under this Act shall be at least 8 | ||||||
15 | 1/2 inches by 11 inches in size, written in a 16-point font, | ||||||
16 | and shall state the following: | ||||||
17 | "If you or someone you know is being forced to engage in any | ||||||
18 | activity and cannot leave, whether it is commercial sex, | ||||||
19 | housework, farm work, construction, factory, retail, or | ||||||
20 | restaurant work, or any other activity, call the National Human | ||||||
21 | Trafficking Resource Center at 1-888-373-7888 to access help | ||||||
22 | and services. | ||||||
23 | Victims of slavery and human trafficking are protected under |

1 | United States and Illinois law.
The hotline is: | ||||||
2 | * Available 24 hours a day, 7 days a week. | ||||||
3 | * Toll-free. | ||||||
4 | * Operated by nonprofit nongovernmental organizations. | ||||||
5 | * Anonymous and confidential. | ||||||
6 | * Accessible in more than 160 languages. | ||||||
7 | * Able to provide help, referral to services, training, | ||||||
8 | and general information.". | ||||||
9 | (c) The notice shall be printed in English, Spanish, and in | ||||||
10 | one other language that is the most widely spoken language in | ||||||
11 | the county where the establishment is located and for which | ||||||
12 | translation is mandated by the federal Voting Rights Act, as | ||||||
13 | applicable. This subsection does not require a business or | ||||||
14 | other establishment in a county where a language other than | ||||||
15 | English or Spanish is the most widely spoken language to print | ||||||
16 | the notice in more than one language in addition to English and | ||||||
17 | Spanish. | ||||||
18 | Section 15. Model notice. No later than 6 months after the | ||||||
19 | effective date of this Act, the Department of Human Services | ||||||
20 | shall develop a model notice that complies with the | ||||||
21 | requirements of this Act and make the model notice available | ||||||
22 | for download on the Department's Internet website. | ||||||
23 | Section 20. Penalties. A business or establishment that | ||||||
24 | fails to comply with the requirements of this Act is liable for |

1 | a civil penalty of $500 for a first offense and $1,000 for each | ||||||
2 | subsequent offense. The State's Attorney or the Attorney | ||||||
3 | General may bring an action to impose a civil penalty pursuant | ||||||
4 | to this Section against a business or establishment if a local | ||||||
5 | or State agency with authority to regulate that business or | ||||||
6 | establishment has satisfied both of the following: | ||||||
7 | (1) provided the business or establishment with | ||||||
8 | reasonable notice of noncompliance that informs the | ||||||
9 | business or establishment that it is subject to a civil | ||||||
10 | penalty if it does not correct the violation within 30 days | ||||||
11 | from the date the notice is sent to the business or | ||||||
12 | establishment; and | ||||||
13 | (2) verified that the violation was not corrected | ||||||
14 | within the 30-day period described in paragraph (1).
