| 2 | | (2) Adult entertainment facilities, as defined in |
| 3 | | Section 5-1097.5 of the Counties Code. |
| 4 | | (3) Primary airports, as defined in Section 47102(16) |
| 5 | | of Title 49 of the United States Code. |
| 6 | | (4) Intercity passenger rail or light rail stations. |
| 7 | | (5) Bus stations. |
| 8 | | (6) Truck stops. For purposes of this Act, "truck stop" |
| 9 | | means a privately-owned and operated facility that |
| 10 | | provides food, fuel, shower or other sanitary facilities, |
| 11 | | and lawful overnight truck parking. |
| 12 | | (7) Emergency rooms within general acute care |
| 13 | | hospitals. |
| 14 | | (8) Urgent care centers. |
| 15 | | (9) Farm labor contractors. For purposes of this Act, |
| 16 | | "farm labor contractor" means: (i) any person who for a fee |
| 17 | | or other valuable consideration recruits, supplies, or |
| 18 | | hires, or transports in connection therewith, into or |
| 19 | | within the State, any farmworker not of the contractor's |
| 20 | | immediate family to work for, or under the direction, |
| 21 | | supervision, or control of, a third person; or (ii) any |
| 22 | | person who for a fee or other valuable consideration |
| 23 | | recruits, supplies, or hires, or transports in connection |
| 24 | | therewith, into or within the State, any farmworker not of |
| 25 | | the contractor's immediate family, and who for a fee or |
| 26 | | other valuable consideration directs, supervises, or |

| 1 | | controls all or any part of the work of the farmworker or |
| 2 | | who disburses wages to the farmworker. However, "farm labor |
| 3 | | contractor" does not include full-time regular employees |
| 4 | | of food processing companies when the employees are engaged |
| 5 | | in recruiting for the companies if those employees are not |
| 6 | | compensated according to the number of farmworkers they |
| 7 | | recruit. |
| 8 | | (10) Privately-operated job recruitment centers. |
| 9 | | (b) The Department of Transportation shall, upon the |
| 10 | | availability of the model notice described in Section 15 of |
| 11 | | this Act, post a notice that complies with the requirements of |
| 12 | | this Act in a conspicuous place near the public entrance of |
| 13 | | each roadside rest area or in another conspicuous location in |
| 14 | | clear view of the public and employees where similar notices |
| 15 | | are customarily posted. |
| 16 | | Section 10. Form of posted notice. |
| 17 | | (a) The notice required under this Act shall be at least 8 |
| 18 | | 1/2 inches by 11 inches in size, written in a 16-point font, |
| 19 | | and shall state the following: |
| 20 | | "If you or someone you know is being forced to engage in any |
| 21 | | activity and cannot leave, whether it is commercial sex, |
| 22 | | housework, farm work, construction, factory, retail, or |
| 23 | | restaurant work, or any other activity, call the National Human |
| 24 | | Trafficking Resource Center at 1-888-373-7888 to access help |

| 1 | | and services. |
| 2 | | Victims of slavery and human trafficking are protected under |
| 3 | | United States and Illinois law.

| 11 | | (b) The notice shall be printed in English, Spanish, and in |
| 12 | | one other language that is the most widely spoken language in |
| 13 | | the county where the establishment is located and for which |
| 14 | | translation is mandated by the federal Voting Rights Act, as |
| 15 | | applicable. This subsection does not require a business or |
| 16 | | other establishment in a county where a language other than |
| 17 | | English or Spanish is the most widely spoken language to print |
| 18 | | the notice in more than one language in addition to English and |
| 19 | | Spanish. |
| 20 | | Section 15. Model notice. No later than 6 months after the |
| 21 | | effective date of this Act, the Department of Human Services |
| 22 | | shall: (i) develop a model notice that complies with the |
| 23 | | requirements of Section 10 of this Act; or (ii) adopt a model |

| 1 | | notice developed by the Illinois Task Force on Human |
| 2 | | Trafficking that complies with the requirements of Section 10 |
| 3 | | of this Act. The Department of Human Services shall make the |
| 4 | | model notice available for download on the Department's |
| 5 | | Internet website. |
| 6 | | Section 20. Penalties. |
| 7 | | (a) A business or establishment identified in subsection |
| 8 | | (a) of Section 5 that fails to comply with the requirements of |
| 9 | | this Act is liable for a civil penalty of $500 for a first |
| 10 | | offense and $1,000 for each subsequent offense. |
| 11 | | (b) The Department of Labor shall, in the course of |
| 12 | | regulating a business or establishment, monitor and enforce |
| 13 | | compliance with this Act. Upon discovering a violation, the |
| 14 | | Department of Labor shall provide the business or establishment |
| 15 | | with reasonable notice of noncompliance that informs the |
| 16 | | business or establishment that it is subject to a civil penalty |
| 17 | | if it does not correct the violation within 30 days from the |
| 18 | | date the notice is sent to the business or establishment. |
| 19 | | (c) If the Department of Labor verifies that the violation |
| 20 | | was not corrected within the 30-day period described in |
| 21 | | subsection (b), the Attorney General may bring an action to |
| 22 | | impose a civil penalty pursuant to this Section.".
