AMENDMENT TO HOUSE BILL 2791




2    AMENDMENT NO. ______. Amend House Bill 2791 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Department of Healthcare and Family 
5Services Law of the
Civil Administrative Code of Illinois is 
6amended by adding Section 2205-25 as follows:
 
7    (20 ILCS 2205/2205-25 new)
8    Sec. 2205-25. Barriers to paying child support; study.
9    (a)  Subject to appropriation, the Division of Child Support 
10Services of the Department of Healthcare and Family Services  
11shall conduct a study regarding the barriers individuals face 
12to paying child support.  The purpose of the study shall be to 
13identify and minimize barriers to paying child support so as to 
14decrease the total amount of unpaid child support in Illinois.  
15The study shall focus on the following: 
16        (1)  demographics of those who fail to pay child

1    support, including: income, education level, age at first 
2    becoming a parent, ratio of monthly child support to 
3    monthly income, criminal history, child visits per month, 
4    number of children, substance abuse history, whether the 
5    individual is on probation or parole, and primary language 
6    spoken; 
7        (2)  institutional barriers to paying child support, 
8    including how and when it is collected; 
9        (3)  the impact, if any, that unpaid child support 
10    information has on an individual's ability to be 
11    considered, interviewed, and hired by an employer, 
12    including: (i) whether credit and background checks reveal 
13    unpaid child support obligations, including, but not 
14    limited to, amounts in arrears, civil judgments, and 
15    criminal convictions for failure to pay child support, and 
16    (ii) whether the information revealed in a credit or 
17    background check regarding unpaid child support prevents 
18    applicants from gaining employment. 
19    (b)  The Department shall report the results of the study 
20and any recommendations to the Governor and the General 
21Assembly on or before May 1, 2017. 
22    (c)  The Department shall adopt rules addressing the results 
23and recommendations of the study. 
24    (d)   This Section is repealed on January 1, 2018. 
 

25    Section 99. Effective date. This Act takes effect July 1,
