Amends the Illinois Public Aid Code. Requires the Department of Human Services to develop a 2-year pilot program requiring a drug test as a condition of eligibility for Temporary Assistance for Needy Families (TANF) benefits. Provides that the pilot program shall operate in 4 counties as prescribed by the Department; and that persons subject to the drug test shall include (i) adult applicants and recipients who are suspected of using a controlled substance; and (ii) all mothers who receive TANF benefits. Provides that an individual who tests positive for a controlled substance as a result of a drug test required under the pilot program shall be ineligible to receive TANF benefits for one year after the date of the positive drug test, unless the individual verifies the successful completion of a substance
abuse treatment program. Requires the Department to submit an interim report to the Governor and the General Assembly, within 6 months after the effective date of the amendatory Act, on the Department's progress in developing the pilot program and implementing the pilot program. Requires the Department to submit a final report to the Governor and the General Assembly at the completion of the pilot program. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 12-4.49 as follows: |
6 | | (305 ILCS 5/12-4.49 new) |
7 | | Sec. 12-4.49. Drug testing pilot program. The Department of |
8 | | Human Services shall develop a 2-year pilot program requiring a |
9 | | drug test as a condition of eligibility for Temporary |
10 | | Assistance for Needy Families (TANF) benefits provided under |
11 | | Article IV of this Code. The pilot program shall operate in 4 |
12 | | counties as prescribed by the Department. Persons subject to |
13 | | the drug test required under the pilot program shall include: |
14 | | (1) Adult applicants and recipients who are suspected |
15 | | of using a controlled substance. |
16 | | (2) All mothers who receive TANF benefits. |
