AMENDMENT TO HOUSE BILL 3099

AMENDMENT NO. ______. Amend House Bill 3099 as follows:

on page 1, line 5, after "6" by adding "and by adding Section 24"; and

on page 15, immediately following line 14 by adding the following:

"(70 ILCS 805/24 new)

Sec. 24. Taxpayer rebate. Notwithstanding any provision of law to the contrary:

(a) All fund reserves in possession of the DuPage County Forest Preserve District, except for funds held in the Endowment Fund created under Section 13.7 of this Act, shall be returned to property taxpayers of record, on a pro-rata basis, within 60 days of the 2018 general election. However, up to 15% of all fund reserves, or a greater amount if approved by a three-fifths majority vote of the DuPage County Board of Commissioners, except for funds held in the Endowment Fund, may be expended for DuPage Forest Preserve District liabilities outstanding on the day of the 2018 general election. For purposes of this subsection (a), "taxpayers of record" shall be determined on the day of the 2018 general election.

(b) The DuPage County Auditor, or an independent third-party entity knowledgeable and qualified in the field of government accounting and auditing as retained by a majority vote of the DuPage County Board of Commissioners, shall provide a certified audit of the DuPage County Forest Preserve District fund reserves and outstanding liabilities on the day of the 2018 general election.

(c) After the effective date of this Amendatory Act of the 99th General Assembly through 61 days after the 2018 general election, no fund reserves of the DuPage County Forest Preserve District may be used for any capital acquisitions, capital improvements, or extraordinary operational expenses.

(d) The control and management of all bequests and donations made to the DuPage County Forest Preserve District, including funds held in the Endowment Fund created under Section 13.7 of this Act, received prior to, on, and after the effective date of this amendatory Act of the 99th General Assembly shall transfer to the DuPage County Board of Commissioners as provided in Section 3c of this Act, and the Board of Commissioners shall strictly comply with the express requirements of each such bequest or donation transferred.

(e) It is the express intent of the General Assembly to strongly encourage the DuPage County Board of Commissioners to apply fiscal savings obtained through operational efficiencies achieved by this amendatory Act of the 99th General Assembly towards a reduced operating levy, direct rebate to taxpayers of record, or both.".
