    Amends the Coal Mining Act. Defines "recorder". Provides that a mine examiner shall record the report either by calling out to a recorder or personally recording the report. Provides that the recorder or mine examiner shall record the report in a book or computer system that is provided by the operator for that purpose, and the book or computer system shall be secure and not susceptible to alteration. Makes other changes. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Coal Mining Act is amended by changing
5Sections 5.11, 6.10, and 6.11 and by adding Section 1.25 as
6follows:
 
7    (225 ILCS 705/1.25 new)
8    Sec. 1.25. Recorder. "Recorder" means a person trained and
9designated by the operator as the individual responsible for
10recording the mine examiner's examination of the underground
11workings of the mine.

13    Sec. 5.11. To see that a mine examiner makes the
14examinations provided in Articles 5, 6, and 31 of this Act, and
15that he or she enters his or her report either by calling it
16out to the surface to a recorder or by personally recording the
17report. The recorder or mine examiner shall record the report
18in a book or computer system that is provided by the operator
19for that purpose, and the book or computer system shall be
20secure and not susceptible to alteration. thereof with
21indelible pencil or ink in a well-bound or properly protected
22loose leaf book provided by the operator for that purpose.

3    Sec. 6.10. Upon completing his or her examination, he or
4she shall make a daily record of the same either by calling out
5the results of the examination to a recorder or by personally
6recording the report. The recorder or mine examiner shall
7record the report in a book or computer system that is provided
8by the operator for that purpose, and the book or computer
9system shall be secure and not susceptible to alteration. The
10mine examination report is in a book kept for that purpose, for
11the information of the company, the State Mine Inspector, and
12all other persons interested; and this report record shall be
13recorded made each morning before the miners are permitted to
14enter the mine.

17    Sec. 6.11. Should any dangerous conditions be found as
18described in Section 6.09, he or she shall call the conditions
19out to a recorder or shall personally record the report. The
20recorder or mine examiner shall record the report in a book or
21computer system that is provided by the operator for that
22purpose, and the book or computer system shall be secure and
23not susceptible to alteration. The recorder or mine examiner
24shall ensure that the report sets record the same in the daily

2conditions found and the location of same.
