Amends the Illinois Public Aid Code. Provides that to the extent permitted by federal law and notwithstanding any other provision of the Code to the contrary, all persons incarcerated for at least 6 months at a county jail, juvenile detention center, or State correctional facility shall have their eligibility for medical assistance determined by the Department of Human Services prior to their release from custody. Grants the Department of Human Services rulemaking authority.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 1-8.6 as follows: |
6 | | (305 ILCS 5/1-8.6 new) |
7 | | Sec. 1-8.6. Incarcerated persons; medical assistance |
8 | | determinations. To the extent permitted by federal law and |
9 | | notwithstanding any other provision of this Code to the |
10 | | contrary, all persons incarcerated for at least 6 months at a |
11 | | county jail, juvenile detention center, or State correctional |
12 | | facility shall have their eligibility for medical assistance |
13 | | determined by the Department of Human Services prior to their |
14 | | release from custody. Counties, the Department of Juvenile |
15 | | Justice, the Department of Healthcare and Family Services, and |
16 | | the Department of Corrections shall cooperate with the |
17 | | Department of Human Services in implementing this Section. The |
18 | | Department of Human Services shall adopt any rules necessary to |
19 | | implement this provision.
