Amends the Compassionate Use of Medical Cannabis Pilot Program Act. Provides that patient registry identification cards issued prior to the date the first dispensary organization registration is issued by the Department of Financial and Professional Regulation shall be extended for a period of one year from the date such registration is issued without further fee to the cardholder. Requires the Department of Financial and Professional Regulation to file with the Index Department of the Office of the Secretary of State a declaration to that effect, and to notify the Clerk of the House of Representatives, the Secretary of the Senate, and the Legislative Reference Bureau of the filing of the declaration. Extends the date of repeal of the Act from January 1, 2018 to 4 years after the filing of the declaration.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Compassionate Use of Medical Cannabis Pilot |
5 | | Program Act is amended by changing Sections 70 and 220 as |
6 | | follows: |

9 | | Sec. 70. Registry identification cards. |
10 | | (a) A registered qualifying patient or designated |
11 | | caregiver must keep their registry identification card in his |
12 | | or her possession at all times when engaging in the medical use |
13 | | of cannabis. |
14 | | (b) Registry identification cards shall contain the |
15 | | following:
|
16 | | (1) the name of the cardholder;
|
17 | | (2) a designation of whether the cardholder is a |
18 | | designated caregiver or qualifying patient;
|
19 | | (3) the date of issuance and expiration date of the |
20 | | registry identification card;
|
21 | | (4) a random alphanumeric identification number that |
22 | | is unique to the cardholder;
|
23 | | (5) if the cardholder is a designated caregiver, the |

1 | | random alphanumeric identification number of the |
2 | | registered qualifying patient the designated caregiver is |
3 | | receiving the registry identification card to assist; and
|
4 | | (6) a photograph of the cardholder, if required by |
5 | | Department of Public Health rules.
|
6 | | (c) To maintain a valid registration identification card, a |
7 | | registered qualifying patient and caregiver must annually |
8 | | resubmit, at least 45 days prior to the expiration date stated |
9 | | on the registry identification card, a completed renewal |
10 | | application, renewal fee, and accompanying documentation as |
11 | | described in Department of Public Health rules. The Department |
12 | | of Public Health shall send a notification to a registered |
13 | | qualifying patient or registered designated caregiver 90 days |
14 | | prior to the expiration of the registered qualifying patient's |
15 | | or registered designated caregiver's identification card. If |
16 | | the Department of Public Health fails to grant or deny a |
17 | | renewal application received in accordance with this Section, |
18 | | then the renewal is deemed granted and the registered |
19 | | qualifying patient or registered designated caregiver may |
20 | | continue to use the expired identification card until the |
21 | | Department of Public Health denies the renewal or issues a new |
22 | | identification card.

23 | | The expiration date for all registry identification cards |
24 | | issued to patients or designated caregivers under this Section |
25 | | prior to the date the first dispensary organization |
26 | | registration is issued by the Department of Financial and |

1 | | Professional Regulation shall be extended for a period of one |
2 | | year from the date such registration is issued without further |
3 | | fee to the cardholder. On the date the first dispensary |
4 | | organization registration is issued, the Department of |
5 | | Financial and Professional Regulation shall file with the Index |

10 | | (d) Except as otherwise provided in this Section, the |
11 | | expiration date is one year after the date of issuance.

12 | | (e) The Department of Public Health may electronically |
13 | | store in the card any or all of the information listed in |
14 | | subsection (b), along with the address and date of birth of the |
15 | | cardholder and the qualifying patient's designated dispensary |
16 | | organization, to allow it to be read by law enforcement agents.

20 | | Sec. 220. Repeal of Act. This Act is repealed 4 years after |
21 | | the occurrence of the conditions set forth in subsection (c) of |
22 | | Section 70 effective date of this Act .
