AMENDMENT TO HOUSE BILL 3573 




2    AMENDMENT NO. ______. Amend House Bill 3573 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Humane Care for Animals Act is amended  by 
5changing Section 4 as follows:
 



6    (510 ILCS 70/4)  (from Ch. 8, par. 704)



7    Sec. 4. Prohibited acts. No employee or volunteer of a 
8carnival or fair person may sell, offer for sale, barter,
or 
9give away as a pet or a novelty any rabbit, hermit crab, 
10goldfish, or any baby chick, duckling or
other fowl which has 
11been dyed, colored, or otherwise treated to impart an

12artificial color thereto.  Baby chicks or ducklings shall not be 
13sold, offered
for sale, bartered, or given away as pets or 
14novelties.  Rabbits, ducklings
or baby chicks shall not be 
15awarded as prizes.

16    As used in this Section, "carnival" has the meaning given

1to that term in the Carnival Regulation Act and "fair" has the 
2meaning given to that term in the Amusement Ride and Attraction 
3Safety Act. 
4    A person convicted of violating this Section is guilty of a 
5Class B
misdemeanor.  A second or subsequent violation is a 
6Class 4 felony, with
every day that a violation continues 
7constituting a separate offense.
