| 2 | | assistance program under Article V of the Illinois Public |
| 3 | | Aid Code, or the patient's insurance policy for the current |
| 4 | | hospital services, including medications and other |
| 5 | | pharmaceutical supplies, as well as coverage for any |
| 6 | | subsequent discharge to a skilled nursing facility or for |
| 7 | | home and community based care; and |
| 8 | | (2) a statement that the patient should contact his or |
| 9 | | her insurance provider to better understand the |
| 10 | | implications of being placed into observation status. |
| 11 | | Section 10. The Hospital Licensing Act is amended by adding |
| 12 | | Section 6.09b as follows: |
| 13 | | (210 ILCS 85/6.09b new) |
| 14 | | Sec. 6.09b. Patient notice of observation status. Within |
| 15 | | 24 hours after a patient's placement into observation status by |
| 16 | | a hospital, the hospital shall provide that patient with an |
| 17 | | oral and written notice that the patient is not admitted to the |
| 18 | | hospital and is under observation status. The written notice |
| 19 | | shall be signed by the patient or the patient's legal |
| 20 | | representative to acknowledge receipt of the written notice and |
| 21 | | shall include, but not be limited to, the following |
| 22 | | information: |
| 23 | | (1) a statement that observation status may affect |
| 24 | | coverage under the federal Medicare program, the medical |

| 10 | | Section 99. Effective date. This Act takes effect upon |
| 11 | | becoming law.".
