2 | | assistance program under Article V of the Illinois Public |
3 | | Aid Code, or the patient's insurance policy for the current |
4 | | hospital services, including medications and other |
5 | | pharmaceutical supplies, as well as coverage for any |
6 | | subsequent discharge to a skilled nursing facility or for |
7 | | home and community based care; and |
8 | | (2) a statement that the patient should contact his or |
9 | | her insurance provider to better understand the |
10 | | implications of being placed into observation status. |
11 | | Section 10. The Hospital Licensing Act is amended by adding |
12 | | Section 6.09b as follows: |
13 | | (210 ILCS 85/6.09b new) |
14 | | Sec. 6.09b. Patient notice of observation status. Within |
15 | | 24 hours after a patient's placement into observation status by |
16 | | a hospital, the hospital shall provide that patient with an |
17 | | oral and written notice that the patient is not admitted to the |
18 | | hospital and is under observation status. The written notice |
19 | | shall be signed by the patient or the patient's legal |
20 | | representative to acknowledge receipt of the written notice and |
21 | | shall include, but not be limited to, the following |
22 | | information: |
23 | | (1) a statement that observation status may affect |
24 | | coverage under the federal Medicare program, the medical |

10 | | Section 99. Effective date. This Act takes effect upon |
11 | | becoming law.".
