SYNOPSIS AS INTRODUCED:

210 ILCS 85/6.22a new

    Amends the University of Illinois Hospital Act and the Hospital Licensing Act. Requires a hospital to provide notice of a patient's outpatient status to the patient or the patient's designee if: (1) the patient receives onsite services from the hospital for more than 23 consecutive hours; (2) the onsite services received by the patient include a hospital bed and meals that have been provided in an area of the hospital other than the hospital emergency room; and (3) the patient has not been formally admitted as an inpatient at the hospital. Requires the notice to include certain information concerning insurance coverage. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Hospital Act is
5amended by adding Section 8a as follows:
 
6    (110 ILCS 330/8a new)
7    Sec. 8a. Notice to patient of outpatient status.
8    (a) The University of Illinois Hospital shall provide
9notice of a patient's outpatient status to the patient or the
10patient's designee if:
11        (1) the patient receives onsite services from the
12    hospital for more than 23 consecutive hours;
13        (2) the onsite services received by the patient include
14    a hospital bed and meals that have been provided in an area
15    of the hospital other than the hospital emergency room; and
16        (3) the patient has not been formally admitted as an
17    inpatient at the hospital.
18    (b) The patient notice required under subsection (a) shall
19include a statement that:
20        (1) outpatient observation status may impact coverage
21    determinations made by the federal Medicare program or the
22    patient's insurance company for hospital and post-hospital
23    payments;

1        (2) final decisions related to outpatient observation
2    status can be made after a patient is no longer a patient
3    at the hospital and after a patient has received hospital
4    services or other services; and
5        (3) a patient should contact his or her provider of
6    benefits under the Medicare or Medicaid program or his or
7    her health insurance provider if the patient has specific
8    questions about the coverage.
 
9    Section 10. The Hospital Licensing Act is amended by adding
10Section 6.22a as follows:
 
11    (210 ILCS 85/6.22a new)
12    Sec. 6.22a. Notice to patient of outpatient status.
13    (a) A hospital shall provide notice of a patient's
14outpatient status to the patient or the patient's designee if:
15        (1) the patient receives onsite services from the
16    hospital for more than 23 consecutive hours;
17        (2) the onsite services received by the patient include
18    a hospital bed and meals that have been provided in an area
19    of the hospital other than the hospital emergency room; and
20        (3) the patient has not been formally admitted as an
21    inpatient at the hospital.
22    (b) The patient notice required under subsection (a) shall
23include a statement that:
