| 4 | | "However, the authority of the Department to adopt an emergency |
| 5 | | rule under this subsection (b) to add a new chemical formula to |
| 6 | | the current list of chemical formulas that are listed in this |
| 7 | | Act as scheduled controlled substances excludes the scheduling |
| 8 | | of any non-narcotic drug if the drug may be lawfully sold |
| 9 | | over-the-counter or behind the counter without a |
| 10 | | prescription.".
