Amends the Cannabis Control Act. Creates the offense of unlawful use of cannabis-based product manufacturing equipment. Provides that a person commits the offense when he or she knowingly engages in the possession, procurement, transportation, storage, or delivery of any equipment used in the manufacturing of any cannabis-based product, including, but not limited to canisters of butane gas with the intent to manufacture, compound, covert, produce, derive, process, or prepare either directly or indirectly by chemical extraction or independently by means of chemical synthesis, any product of cannabis. Provides that a violation is a Class 2 felony.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Cannabis Control Act is amended by adding |
5 | | Section 5.3 as follows: |
6 | | (720 ILCS 550/5.3 new) |
7 | | Sec. 5.3. Unlawful use of cannabis-based product |
8 | | manufacturing equipment. |
9 | | (a) A person commits unlawful use of cannabis-based product |
10 | | manufacturing equipment when he or she knowingly engages in the |
11 | | possession, procurement, transportation, storage, or delivery |
12 | | of any equipment used in the manufacturing of any |
13 | | cannabis-based product, including, but not limited to |
14 | | canisters of butane gas with the intent to manufacture, |
15 | | compound, covert, produce, derive, process, or prepare either |
16 | | directly or indirectly by chemical extraction or independently |
17 | | by means of chemical synthesis, any product of cannabis. |
18 | | (b) Sentence.
A person who violates this Section is guilty |
19 | | of a Class 2 felony.
