SYNOPSIS AS INTRODUCED:
 
110 ILCS 947/20

    Amends the Higher Education Student Assistance Act. Provides that the Illinois Student Assistance Commission is authorized to deny and shall immediately revoke a scholarship or grant to any person who has been convicted of a violent crime, as defined under the Rights of Crime Victims and Witnesses Act. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Higher Education Student Assistance Act is
5amended by changing Section 20 as follows:
 
6    (110 ILCS 947/20)
7    Sec. 20. Functions of Commission.
8    (a) The Commission, in accordance with this Act, shall
9prepare and supervise the issuance of public information
10concerning its provisions; prescribe the form and regulate the
11submission of applications for assistance; provide for and
12conduct, or cause to be conducted, all eligibility
13determinations of applicants; award the appropriate financial
14assistance; and, upon request by a member of the General
15Assembly, nominate or evaluate and recommend for nomination
16applicants for General Assembly scholarships in accordance
17with criteria specified by the member under Section 30-9 of the
18School Code.
19    (b) The Commission is authorized to participate in any
20programs for monetary assistance to students and to receive,
21hold, and disburse all such funds made available by any agency
22or organization for the purpose or purposes for which they are
23made available. The Commission is authorized to administer a

1program of grant assistance as authorized by the Baccalaureate
2Savings Act. The Commission is authorized to participate in any
3programs established to improve student financial aid services
4or the proficiency of persons engaged in student financial aid
5services and to receive, hold, and disburse all funds made
6available by any agency or organization for the purpose or
7purposes for which they are made available subject to the
8appropriations of the General Assembly.
9    (c) The Commission is authorized to deny a scholarship or a
10grant to any person who has defaulted on a guaranteed student
11loan and who is not maintaining a satisfactory repayment
12record. If a person has a defaulted guaranteed student loan but
13is otherwise eligible for assistance pursuant to Section 40,
14the Commission shall award one term of assistance during which
15a satisfactory repayment record must be established. If such a
16repayment record is not established, additional assistance
17shall be denied until a satisfactory repayment record is
18established.
19    (c-5) Notwithstanding any other provision of this Act, the
20Commission is authorized to deny and shall immediately revoke a
21scholarship or grant to any person who has been convicted of a
22violent crime, as defined under Section 3 of the Rights of
23Crime Victims and Witnesses Act.
24    (d) The Commission is authorized to participate with
25federal, state, county, local, and university law enforcement
26agencies in cooperative efforts to detect and prosecute

1incidents of fraud in student assistance programs.
2    (e) The Administrative Review Law shall apply to and govern
3all proceedings for the judicial review of final administrative
4decisions of the Commission.
5    (f) The Commission is authorized to make all necessary and
6proper rules, not inconsistent with this Act, for the efficient
7exercise of the foregoing functions.
8    (g) Unless otherwise provided by statute, the functions of
9the Commission shall be exercised without regard to any
10applicant's race, creed, sex, color, national origin, or
11ancestry.
12    (h) The Commission is authorized to establish systems and
13programs to encourage employers to match employee
14contributions to prepaid programs of college savings by making
15donations to the Commission for prepaid programs of college
16savings to make higher education affordable for all residents
17of the State and to receive, hold, and disburse all such funds
18made available through those programs for the purposes for
19which they are authorized by rule or by law.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
